440 <br /> <br />RESOLUTION 94-023 <br /> <br />17. <br /> <br />The project sponsor shall implement a Transportation Demand Management <br />Program CTDMP) included in Appendix C of the Traffic Analysis through the <br />CC&Rs on the project. The TDMP shall (I) set a performance standard of a <br />15% reduction in trips otherwise anticipated, (2) require annual monitoring of <br />traffic as compared to the standard, (3) contain a broad range of secondary <br />TDM strategies to further reduce traffic, and (4) require that the project <br />owners either pay a TDM penalty fee or implement the secondary strategies <br />until the standard is met. <br /> <br />18. Participation in TSIA area-wide fee programs. <br /> <br />24. <br /> <br />In addition to project specific mitigation measures listed above, the project <br />sponsor shall participate in the TSIA area wide traffic fee programs. <br /> <br />The project will cause four intersections immediately adjacent to the project currently <br />operating at acceptable level of service to operate at unacceptable levels of service <br />(80% of capacity or higher). Mitigation measures nos. 7 through 11, and 13 through <br />16 require the project proponent to complete all City master-planned improvements <br />for those adjacent intersections and adjacent roadways on all fight-of-way owned by <br />the proponent and through acquisition of right-of-way from the owner of property on <br />the north side of 17th Street and on Tustin Avenue immediately south of the project. <br /> <br />Mitigation measure no. 17 is designed to further reduce traffic impacts on those <br />roadways and intersections through implementation of a Transportation Demand <br />Management Program. The TDMP is designed to ensure that vehicle trips to the <br />project are reduced by 155 from average levels generated for similar projects of <br /> <br />Mitigation measure no. 18 on the project requires the pwponent to pay at the time of <br />building permit issuance $1,054,952 in Santa Ana/Tustin Transportation System <br />Improvement Area CTSIA) fees and $436,861 in Orange County Transportation <br />Management Fees as its pro rata contribution to transportation improvements designed <br />to mitigation area-wide traffic conditions, including traffic attributable to the project. <br />These fees are based on current ordinances and are triggered at the time of building <br />permit issuance. These ordinances are subject to change prior to that issuance. <br /> <br />Some changes or alterations are within the responsibility or <br />jurisdiction of another public agency and not the agency making <br />the finding. Such changes have been adopted by such other <br />agency or can and should be adopted by such other agency. <br /> <br />Facts in Suo~ort of the Finding, <br /> <br />The EIR states that the following potential improvement would mitigate cumulative <br />traffic impacts at the intersection of Tustin and Santa Clara.
