RESOLUTION 96-027 <br /> 4?0 <br /> <br />Variance No. 95-9 <br />Findings of Fact <br />March 18, 1996 <br />Page 1 of 1 <br /> <br />These findings are for the approval of those variances recommended for <br />approval. <br /> <br />Findings <br /> <br />ae <br /> <br />Special circumstances exist on this property, including size, <br />shape, topography, location or surroundings, where the strict <br />application of the zoning ordinance is found to deprive the <br />subject property of privileges not otherwise at variance with <br />the intent and purpose of the provisions of this chapter. <br /> <br />The variances are a benefit to the center and the community <br />by providing relief from standards which can not be met. <br /> <br />The granting of a variance is necessary for the preservation and <br />enjoyment of one or more substantial property rights. <br /> <br />The requests are necessary to construct this retail center. <br /> <br />The granting of a variance will not be materially detrimental to <br />the public welfare or injurious to surrounding property. <br /> <br />Approving the variances would not have a negative impact on <br />the surrounding property or the public in general. The <br />retail center will provide a benefit to the community. <br />Mitigation measures are being required where necessary and <br />appropriate. <br /> <br />The granting of a variance will not adversely affect the general <br />plan of the city. <br /> <br />The variance will not have a negative effect on the general <br />plan. <br /> <br />EXHIBIT A <br /> <br /> <br />
