b,~HEARING~r - A.A. 441 MaYor Hall opened the hearing on <br /> Amendment Application 441 filed by <br /> Laurence E. Nelton to reclassify <br /> frcm the R 2 and R 3 to the C 5 <br /> district, property on the south side of 17th Street between Fairmont and <br /> Santiago. Planning Commission Resolution 5617 recommended denial of the <br /> application. <br /> <br />C. Arthur Nisson, Jr., 2014 N. Broadway, attorney, stated that the Planning <br />C~m,~ission was not unanimous in its decision and the classification change <br />was in conformity with the planning study in the area. Mr. Sanders of <br />Sanders Realty, 826 East 17th Street, asked that a map of 17th Street study <br />be sho~n. Although the map was not available, Mr. Evans of the Planning <br />Department confirmed that properties were recommended for C-5. <br /> <br />On motion of Councilman Gilmore, seconded by Councilman Harvey and carried, <br />Council approved the reclassification and instructed the City Attorney <br />to prepare an amending ordinance according to Exhibit 441 A. <br /> <br />b~HEARING - A.A. 448 Mayor Hall opened the hearing on <br /> Amendment Application 448 filed <br /> by Carl C. Hillgren, to reclassify <br /> from the M i and R i to the R 4 <br /> district, property on the west side of Lyon Street south of Warren Street. <br /> Planni~ Commission Resolution 5617 recommended denial of the application <br /> without prejudice. <br /> <br />Richard F. Featherstone, 1021 Ravencrest Road, spoke on behalf of the <br />applicant, stating that the parcel suffers from dual zoning and since the <br />City presently has a surplus of M i property, the rezoning would be more <br />consistent with land uses and future land utilization. Mr. Featherstone <br />read from a brief and submitted a copy to the Clerk. Orville Milliken, <br />514 So. Lyons, opposed the reclassification because of additional traffic. <br /> <br />There being no further response to the Mayor's call for testimony, the <br />hearing was closed. <br /> <br />It was moved by Councilman Harvey, seconded by Councilman Schlueter, that <br />the reclassification be denied.
