Council heard Dale Heinly, 611 W. 8~h~$~r~e~attorney for the appellant, who <br />explained that the purpose of Variance Application 1759 was to build an eight- <br />foot wall in order to hide the unsightliness of the Junk yard and to build <br />a new wrecking yard office and sales building, neither of which would in any <br />way expand the business. <br /> <br />Warren Finley, attorney representing George Thompson and Willowick Golf Course, <br />spoke in opposition, submitting that granting of the variance would be an <br />expansion of the non-conforming use. There being no further testimony, the <br />hearing was closed. <br /> <br />It was moved by Councilman Harvey, seconded by Councilm~ Hubbard and carried, <br />that the City Council overrule the action of the Planning Cc~mission, grant <br />Variance Application 1759 subject to the construction of an eight-foot wall <br />all around the property and other applicable conditions; and instruct the <br />City Attorney to prepare a resolution setting forth the Council's decision. <br /> <br />~gHEARING - A.A. 439 M~yor Hall opened the hearing on <br /> Amendment Application 439 for <br /> reclassification from the A i to <br /> the C 4 and R h districts, <br /> property on the north side of Santa Clara between Tustin and the Newport <br /> Freeway. Planning Cc~m~ission Resolution 5614 recommended denial of the <br /> application. <br /> <br />The Clerk reported that a petition had been filed, signed by five adjacent <br />property owners, favoring the reclassification, and a letter protesting <br />the reclassification had been filed by the Grovemont Homeowners Association. <br />It was moved by Councilman Hubbard, seconded by Councilman Schlueter and <br />carried that the communications be received and ordered filed. <br /> <br />In response to the Mayor's call for testimony, George Buccola, 3700 Newport <br />Blvd., Newport Beach, spoke in support of the application. <br /> <br />Speaking in opposition, was Jack Turley, 17161 Grovemont Street, representative <br />of a large group attending the meeting. Mr. Turley stated that additional <br />shopping centers were not needed, that the additional noise created would <br />be objectionable, and that property values would decrease. Mr. Turley <br />then submitted a petition signed by 91 home owners who protested the pre- <br />zoning. On motion of Councilman Hubbard, seconded by Councilman Schlueter <br />and carried, the petition was received and filed. There being no further <br />testimony, the hearing was closed. <br /> <br />On motion of Councilman Harvey, seconded by Councilman Schlueter and carried, <br />Council approved the reclassification and instructed the City Attorney to <br />prepare an amending ordi~mnce according to Exhibit AA 439 A. <br /> <br />HEARING - A.A. 440 Mayor Hall opened the hearing on Amend- <br />~ ment Application ~40 filed by Thomas <br /> R. Coughlin to reclassify from the <br /> A I to the R ~ district, property <br />located north of Millwood Streetand Sherry Lane. <br /> <br />There being no response to the Mayor's call for testimony, the hearing was <br />closed. <br /> <br />On motion of Councilman Hubbard, seconded by Councilman GiLmore and carried, <br />Council approved the reclassification and instructed the City Attorney to <br />prepare au amending ordinance according to Exhibit h40 A. <br /> <br />City Council - 101 - May 20, 1963 <br /> <br /> <br />
