<br />Mr. Heinly stated it was not reasonable to ask developers to wait for study,
<br />which the planning Cow~ission indicated would be till October, especially since
<br />it would be necessary to default on escrow; that the Planning Commission had all
<br />exhibits except the proposed layout of property; that the Planning staff should
<br />admit the best place to start changing the overabnndance of M 1 property is on
<br />the edges and there is only one industrial plant south of subject property.
<br />
<br />Mr. Stevens stated the Planning C~ission preferred a delay until the adoptinn
<br />of the Plan, or a delay until data had been compiled hy the Econc~ic Consultant,
<br />or at least a 90 to 120 day delay for a study of the several applications. Mr.
<br />Heinly objected to the delay, stating it was a policy determination by Council;
<br />that two written objections had been filed, but neither protestant was at the
<br />hearing. There being no further testimony, the hearin~ was closed.

<br />It was moved by Councilm~n Hubbard, seconded by Councilma~ Schlueter, that the
<br />reclassification be denied. Councilman Gilmore stated he would vote against the
<br />motion on the premise that a man has the right to develop his property when he
<br />is ready; that he was in favor of approving the application with a clear under-
<br />standing that he was not committed to any further encroachment of M 1 properties.
<br />Councilman Harvey agreed, stating in addition that the request f~ c~rcial
<br />zoning was on South Main Street which is already co~aercially developed and that
<br />the subject property is et the tail end of the industrial area; that property
<br />owners should not have to wait for the General Plan to complete their developments.
<br />Mayor Hall noted that since the beginning of discussion on the General Plan
<br />there has been a tendency on the part of the Planning Co~mission to postpone
<br />actions; that this is an isolated parcel, not necessarily related to the area
<br />north of Warner or Dyer; that with the restriction of CD zoning he would be in
<br />favor of approving the application, not setting a precedent for other areas.
