Lowell, questioned the widsc~
of i~posing OD zaning on any property other than in
the Civic Center, and suggested that the Co~acll,
before al~mr~vix~ this application, give some thought
to whether or not the health~ welfare and safety of
the people are endangered inasmuch as the recent
amendment to the CD District was passed as an
interim ordinance.

~ motio~ of Cou~ci~m~B Hubbard, seconded By Councilman Schlueter, the letters
net already introduced were received and ordered filed.

Dale Heluly, 611 W. 8th Street, attorney for the applicant, noted that onl~y
two objections to the application were presented personally at the City Council
hearimg, and had the application been denied there would have been no legal
way the owner c~uld come back for a certain length of time; that one of the
new imdustries mentioned by ~r. Maxwell was going in directly east of property
containing 6~ u~its of ~alti-residential development; that regarding schools~
it is the responsibility of school district to provide schools when City provides
childrem$ that it will take 20 years to use up presently zoned industrial
property; regarding use of OD z~ming, applicant desires architectural control
to keep develepmont fr~ becoming detrimental to neighbors; that owner has net
been able to sell property for industrial use and is entitled to the reclassifi-
cation and urges that C~uncil pass the ordinance to second reading.

J. He felt that it was
net Just or consistent for the City to claim it is for the walfare of the whole
city amd place the responsibility on one man.

Councilman Narvey stated that he concurred with the Mayor and Councilm-= Gilmore,
and that the matter had been blown ~p out of proportion giving the c~unity
the impression that the Council is not for industry, Jobs, or a solid tax base.

Cl~l~ COUNCIL

August 5, 1963
