Mr. Nisson made rebuttal statements regarding the future of King Street, that
<br />he referred to comments of the PlsB~ing Staff that King will remain a sixty-
<br />foot street with a cul de sac at 8th Street; regarding the traffic that his
<br />figures are based on statistics used by the City; regarding street improvements
<br />that applicant will dedicate and improve streets adjacent to subject property;
<br />that facts on garden apartments do not indicate they become slum areas with
<br />transient population.
<br />
<br />Naomi Pimental, 1509 N. King, asked the Council to retain R-1 zoning or grant
<br />a use or variance permit in order to maintain control° Della Troutman, 1338
<br />Fairway, spoke in opposition to the application. There being no iktrther
<br />testimony, the hearing was closed.
<br />
<br />Van Stevens, Senior Planner of the Planning Department, explained that because
<br />the homes in this area average $5,000 higher than the average home in Santa
<br />Aha, it was felt by the department that the investments of the homeowners
<br />should be preserved. Several alternatives were offered to the Planning
<br />Commission, the obvious alternative being R-2 zoning. As an alternative to
<br />this, R-4 zoning was recommended, which has built-in design and safeguards.
<br />However, the Planning Cummission considered it R-1 and recommended that the
<br />area remain
<br />
<br />It was moved by Councilman Harvey, seconded by Councilm~-n Hubbard and carried,
<br />that Amendment Application ~60 be returned to the Planning C~ission for
<br />further consideration and study with the applicant and neighbors.

<br />A~E~D. APP. 457 Mayor Hail opened the hearing on Amendment
<br />ER00EB Application 457 filed by Alberta M. Brooks
<br /> to reclassify from the A-1 to the R-3
<br /> District property on the south side of West
<br />5th Street between Harbor and Newhope. Pla~uing Commission Resolution 5636
<br />reccmmended denial of applicant's proposal.

<br />The Clerk reported that notice of the hearing was published in The Register on
<br />July 13, 1963, and that a petition with 25 signatures protesting reclassification
<br />was submitted by Julie Kcmrosky, 4020 W. 5th Street; that a letter was received
<br />from the Vutcich family, 4108 W. 5th Street, owners of parcels in this area,
<br />stating that they wish to remain in A-1 District pending completion of the
<br />General Pla~. It was moved by Councilman Hubbard, seconded by Councilman
<br />Schlueter and carried, that the communications be received and ordered filed.

<br />Warren Proctor, 115 W. 15th Street, representing the applicant, submitted a
<br />petition with 131 signatures in favor of the application. It was moved by
<br />Councilman Hubbard, seconded by Counci]m-n Schlueter and carried, that the
<br />petition be received and filed.
<br />
<br />Mr. Proctor stated that the applicant is willing as an alternative to R-3, and
<br />because of the time element, to accept controls under CD zoning, if the controls
<br />were not so stringent that he could not develop it; also, that the application
<br />be amended to delete certain parcels.

<br />Mrs. Julie Komrosky, 4024 N. 5th Street and William A. Klos, 4205 W. 5th Street,
<br />spoke in opposition to the rezoning.
<br />
<br />The following spoke in favor of the rezoning: Mrs. Cecilia M. Bailie, 3922
<br />W. 5th Street; Tom Russell, 12342 Adele Street, Garden Grove, owner of 4120
<br />W. 5th; Cruz Barrios, 1418 N. MarLes Drive; and Fred Snell. There being no
<br />further response to the Mayor's call for testimony, the hearing was closed. In
<br />view of the deletion of parcels from the application and the proposed CD zoning,
<br />it was moved by Councilman Hubbard, seconded by Councilman Schlueter, that
<br />Amendment Application 457 be referred back to the Planning Commission for re-
<br />consideration and rec~endation. On roll call vote:
