106 <br /> <br />The proposed subdivision, as conditioned, conforms to the <br />minimum lot size and street frontage requirements proposed in <br />SD No. 68 as well as meeting the intent of the R-2 zone, the <br />City's subdivision ordinance and the State of California <br />Subdivision Map Act provisions. <br /> <br />The project .site is physically suitable for the type and density of <br />the proposed project. <br /> <br />Each proposed parcel exceeds the minimum required lot size and <br />street frontage for SD No. 68. There are no physical <br />constraints on the site to preclude development. A storm <br />drain was provided in the commercial development to the south <br />to accommodate the future development of this site. The site <br />is otherwise relatively flat and regularly shaped. <br /> <br />The design and improvements of the proposed project will not cause <br />substantial environmental damage or substantially and avoidably <br />injure fish or wildlife or their habitat. <br /> <br />No fish or wildlife will be affected by the approval of the map <br />or by the design and improvements of the project. <br />Environmental Review No. 99-01 has been prepared for the <br />project and has identified mitigation measures aimed at <br />substantially reducing any environmental impacts associated <br />with the project to insignificant levels. Pursuant to Title <br />XIV, California Code of Regulations § 735.5(c) (1), after <br />considering the record as a whole, there is no evidence that <br />the proposed project will have the potential for any adverse <br />effect on wildlife resources or the habitat upon which the <br />wildlife depends. Therefore, pursuant to Fish and Game Code <br />§ 711.2 and Title XIV, CCR § 735.5(a) (3), the payment of Fish <br />and Game Department filing fees is not required in conjunction <br />with this project. <br /> <br />The design or improvements of the proposed project will not cause <br />serious public health problems. <br /> <br />The project design and improvements is not anticipated to <br />cause public health concerns. It is anticipated that the <br />project will be built and sold as a single phased development. <br />This is an in-fill development in compliance with the proposed <br />development standards for this site. <br /> <br />The design or improvements of the proposed project will not <br />conflict with easements necessary for public access through or use <br />of the property within the proposed project. <br /> <br />The proposed tentative map adjusts or creates all easements <br />necessary for public access and utilities for the proposed <br />project. <br /> <br /> 2. The mitigated negative declaration for Project No. ER 99-01 is <br />hereby approved. <br /> <br />2 <br /> <br /> <br />
