3~6 <br /> <br />which will complement and improve the economic <br />viability of the area. <br /> <br />Do <br /> <br />Will the proposed use comply with the regulations and <br />conditions specified in the chapter of the Santa Aha <br />Municipal Code for such use? <br /> <br />The apparent deficiencies in parking are addressed <br />through the unique nature of the use and conditions <br />imposed upon the applicant which severely restrict the <br />floor plan. Due to the specialized use of the Art <br />Institute, the floor plan includes customized art <br />laboratories, lecture classrooms, computer labs, video <br />studios, skills kitchens and administrative offices. <br />Moreover, a condition of approval of the use restricts <br />the applicant to the submitted floor plan. Due to <br />these facts, the strict application of the Code as to <br />parking would create an undue hardship on the applicant <br />and is waived by this Council. Therefore, the proposed <br />art institute, as conditioned, will comply with all <br />regulations and conditions specified in the Santa Ana <br />Municipal Code pertaining to such a development. <br /> <br />E. Will the proposed use affect the General Plan of the City? <br /> <br />The proposed art institute project will not pose any <br />adverse affects on the General Plan designation of <br />Professional and Administrative Office (PAO). The <br />proposed trade school use is permitted in the district <br />subject to approval of a conditional use permit. <br /> <br /> 2. The City Council hereby certifies and approves <br />Mitigated Negative Declaration for Environmental Review No. 99-81. <br /> <br /> 3. This Council finds and determines that, pursuant to <br />Santa Aha Municipal Code Section 41-650, the strict application <br />and enforcement of the regulations in the Code related to the <br />parking requirements will cause an undue hardship to the <br />applicant. Further, this Council finds and determines that the <br />unique nature and character of the proposed project requires <br />modifications to the parking standards applicable for the specific <br />use of the property as an Art Institute for the various reasons as <br />stated in the aforementioned findings incorporated herein. <br /> <br /> 4. Conditional Use Permit No. 99-17 is hereby approved as <br />conditioned in Attachment A, attached hereto and incorporated <br />herein. <br /> <br /> <br />
