355 <br /> <br />GAS: 9/3/99 <br /> <br />RESOLUTION NO. 1999-056 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />CITY OF SANTA ANA APPROVING <br />NO. 99-05, FOR RELIEF FROM <br />PROVISIONS OF THE SIGN CODE i <br />OVERALL HEIGHT, LINEAL <br />SIGN AREA OF A <br />AT 401 ~,,, <br /> <br /> WHEREAS, Sant~ <br />a variance from the provisions of the Santa <br />findings; <br /> <br />: the granting of <br />making certain <br /> <br /> WHEREAS, the Planning Commission held <br />Variance Application No. 99-05, for relief from the sign <br />sign area; and <br /> <br />Lg on July 12, 1999, on <br />ght, lineal footage and <br /> <br /> WHEREAS, the City has determined that, as required pursuant to the California <br />Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Categorical <br />Exemption adequately addresses the expected environmental impacts of the Resolution. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence, both oral and written, submitted at the public hearing <br />held this date this Council finds and determines as follows: <br /> <br />That because of special circumstances applicable to the subject property, including <br />size, shape, topography, location or surroundings, the strict application of the <br />zoning ordinance is found to deprive the subject property of privileges not <br />otherwise at variance with the intent and purpose of the provisions of the <br />Municipal Code; <br /> <br />The granting of a variance, as conditioned, will allow the monument sign to <br />exceed sign limits, while limiting any additional signs on-site. The <br />limitations for signage are in harmony with the intent of the sign code to <br />reduce sign clutter. <br /> <br />B. That the granting of a variance is necessary for the preservation and enjoyment of <br /> <br /> <br />
