RESOLUTION NO. 199 <br /> <br />A RESOLUTION OF THE CITY O <br />CITY OF SANTA ANA APPRO''ING VARIANCE <br />NO. 99-06, FOR RELIEF FROM CERTAIN <br />PROVISIONS OF THE SIGN CODE RELATED TO <br />OVERALL HEIGHT, LINEAL FOOTAGE AND <br />SIGN AREA OF A MONUMENT SIGN LOCATED <br />AT 3301 SOUTH BRISTOL STREET <br /> <br /> WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of <br />a variance from the provisions of the Santa Ana Municipal Code, upon making certain <br />findings; <br /> <br /> WHEREAS, the Planning Commission held a public hearing on July 12, 1999, on <br />Variance Application No. 99-06, for relief from the sign code for height, lineal footage and <br />sign area; and <br /> <br /> WHEREAS, the City has determined that, as required pursuant to the Califomia <br />Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Categorical <br />Exemption adequately addresses the expected environmental impacts of the Resolution. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence, both oral and written, submitted at the public heating <br />held this date this Council finds and determines as follows: <br /> <br />Ao <br /> <br />That because of special circumstances applicable to the subject property, including <br />size, shape, topography, location or surroundings, the strict application of the <br />zoning ordinance is found to deprive the subject property of privileges not <br />otherwise at variance with the intent and purpose of the provisions of the <br />Municipal Code; <br /> <br />The granting of a variance, as conditioned, will allow the monument sign to <br />exceed sign limits, while limiting any additional signs on-site. The approval <br />to allow the monument sign to exceed the maximum height, lineal footage <br />and sign face area, as conditioned, would not jeopardize the intent of the <br />code to reduce sign clutter. <br /> <br />B. That the granting of a variance is necessary for the preservation and enjoyment of <br /> <br /> <br />
