367 <br /> <br />RESOLUTION NO. 1999-058 <br /> <br />A RESOLUTION OF THE CITY COUNCIL <br />CITY OF SANTA ANA APPROVING <br />NO. 99-07, FOR RELIEF FROM <br />PROVISIONS OF THE SIGN CODE RELATED TO <br />OVERALL HEIGHT, LINEAL FOOTAGE AND <br />SIGN AREA OF A MONUMENT SIGN LOCATED <br />AT 4505 WEST FIRST STREET <br /> <br /> WHEREAS, Santa Aha Municipal Code Section 41-638 provides for the <br />a variance from the provisions of the Santa Ana Municipal Code, upon making <br />findings; <br /> <br /> WHEREAS, the Planning Commission of the City of Santa Ana held a public <br />hearing on July 12, 1999, on Variance Application No. 99-07, for relief from the sign code <br />for height, lineal footage and sign area; and <br /> <br /> WHEREAS, the City has determined that, as required pursuant to the California <br />Environmental Quality Act ("CEQA") and the State CEQA Guideline, a Categorical <br />Exemption adequately addresses the expected environmental impacts of the Resolution. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence, both oral and written, submitted at the public hearing <br />held this date this Council finds and determines as follows: <br /> <br />Ao <br /> <br />That because of special cimumstances applicable to the subject property, including <br />size, shape, topography, location or surroundings, the strict application of the <br />zoning ordinance is found to deprive the subject property of privileges not <br />otherwise at variance with the intent and purpose of the provisions of the <br />Municipal Code; <br /> <br />The approval to allow the monument sign to exceed the maximum height, <br />lineal footage and sign face area would not jeopardize the intent of the sign <br />code. As conditioned, the site would be limited in the number and types of <br />signs, therefore reducing sign clutter a goal of the sign code. <br /> <br />B. That the granting of a variance is necessary for the preservation and enjoyment of <br /> one or more substantial property rights; <br /> <br /> <br />
