The pdvate sector members have been nominated by both the Chamber of Commerce and the Southland Economic Development Corporation, and the public sector nominations have been issued by the respective organizations. The Mayor and City Council have reviewed the nominating letters along with the members' resumes in order to ratify the nominations. The Executive Director of the Community Development Agency and City Attorney shall prepare and serve proper notice upon the PIC to terminate the above-referenced agreement of February 23, 1987, as required by section 12 thereof, due to the fact that the City will no longer be an SDA under the JTPA because the WIA shall take effect on July 1, 2000. The establishment of the WIB is necessary in order to bring WIA funds into the City of Santa Ana. Section 2. The Workforce Investment Board is hereby established pursuant to the Workforce Investment Act in order to insure the involvement of the business and industrial community, including small businesses, minority business enterprises, education, labor organizations, economic development agencies and one-stop delivery system partners in workforce investment activities. Section 3. The Mayor and City Council, after review of the private and public sector nominations for membership, ratifies such nominations and establishes the initial individuals to serve on the Board of the Workforce Investment Board. Hereafter, the individuals who serve on the Board shall be appointed and may be removed and vacancies may be filled by the Mayor and City Council by motion as provided by section 901 of the City Charter, to the extent that such Charter provisions do not conflict with the WIA. Se~ion 4. Pursuant to section 12 of the February 23, 1987 controlling agreement between the City and the PIC, the Private Industry Council is hereby dissolved of all duties and responsibilities, and the newly established WIB shall act on behalf of the PIC until the WIA takes effect on July 1, 2000. Section 5. If any section, subsection, sentence, clause, phrase or word of this Resolution is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have passed and adopted this Resolution, and each and all provisions hereof, irrespective of the fact that one or more provisions may be declared invalid.
