Gonzales from the Planning Cc~mnission's <br />denial of Variance Application 1842 to operate a drive-in food service at 2328 <br />W. McFadden. On motion of Councilman Harvey, seconded by Councilman Gilmore and <br />carried, the hearing was continued to January 6, 196~, 7:30 p.m., in the Council <br />Chambers, at the request of the applicant. <br /> <br />c~ <br />HEARING - APPEAL ll3 Vice Mayor Hubbard opened the hearing <br />ROBINSON on Appeal Application 113 filed by B. <br />(V.A. 18~9 - SCANLON) W. and Patricia G. Robinson from the <br /> Zoning Administrator' s approval of <br />Variance 1839 (Scanlon) to construct a 20 unit, two story apartment complex on <br />C i and R 1 property at 1609 N. King Street. The Clerk reported that notice of <br />the hearing was mailed to adjacent property owners on December 9, 196~ and that <br />no letters of protest had been received. <br /> <br />Bill Robinson, 1515 N. King Street~ appellant, using visual aid charts, maintained <br />that the legal requirements for a variance had not been met and that the purpose <br />of zoning had been overlooked; that no special circtu~stances had been proved; <br />that property rights had not been denied the variance applicant; and approval <br />of this application would set a precedent in the neighborhood. Mr. Robinson <br />stated that he would not object if luxury apartments were built and if the number <br />was limited to ten. <br /> <br />The Planning Director stated it was the opinion of the Znning Administrator~ staff, <br />and Planning C~amission that this location presented itself for some type of <br />development because of its size, shape and approximate location to c~ercial <br />area on 17th Street; that a precedent had been set on the west side of King Street; <br />that the portion of land already zoned c ...... erciaLly could be developed to a <br />greater density than proposed. There being no further testimony~ the hearing <br />was closed. <br /> <br />It was moved by Counci~n Harvey, seconded by Councilman Schlueter and carried, <br />that the Council uphold the action of the Zoning Administrator and instruct the <br />City Attorney to prepare a resolution granting Variance Application 1839. <br /> <br />¢~1~ <br />HEARING - APPEAL 11~ Vice Mayor Hubbard opened the hearing <br />C.U.P. 154 - KANE on Appeal Application 114 filed by <br /> Mathilda N. Kane from the Planning <br /> C~lssion's denial of C.U.P. 154 to <br />convert a portion of a single residence for care of six retarded children at <br />709 N. Mouutaim View Street. The Clerk reported that notice of the hearing was <br />mailed to adjacent property owners on December 9, 1963, and that no written <br />coammmications had been received. <br /> <br />Mathilda N. Xane, applicant, explained that parking had been a major reason for <br />rejection by the Planning ¢~"mlesion~ l~At that in reality parents of these children <br />seldom visited them; and stated there were other businesses in the neighborhood <br />being conducted frem garages. <br /> <br />The Planning Director stated that the Planning C~ission felt this type of use <br />should be confined to transition areas; that they result in lack of off street <br />parking, and if allowed necessary parking should be provided.
