RESOLUTION NO. 2002-068 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING MINOR EXCEPTION NO 2002-03 <br />SEEKING A REDUCTION IN OFF-STREET PARKING FOR <br />THE PROPERTY AT 431 NORTH TUSTIN AVENUE <br /> <br />Kdo/08/12/02 <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />Minor Exception No 2002-03 came before the City Council of the City of <br />Santa Ana for a public hearing on August 19, 2002. <br /> <br />Minor Exception No. 2002-03 has been filed with the City of Santa Ana <br />seeking to reduce the off-street parking requirement from 259 spaces to 254 <br />spaces in order to construct two retail/food use buildings at 431 North Tustin <br />Avenue. <br /> <br />The Planning Commission of the City of Santa Ana held a duly noticed <br />public hearing on July 22, 2002 and determined by a vote of 6:0 (Mondo <br />absent) to recommend the City Council approve Minor Exception No. 2002- <br />03. <br /> <br />D= <br /> <br />The City Council of the City of Santa Ana hereby determines that the <br />following findings, which must be established in order to grant a minor <br />exception from the provisions of the Santa Ana Municipal Code, have been <br />established: <br /> <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or surroundings, <br />the strict application of the zoning ordinance is found to depdve the <br />subject property of privileges'not otherwise at variance with the intent <br />and purpose of the provisions of this chapter. <br /> <br />There are special circumstances applicable to the subject property. <br />The subject site is located on the northeast comer of Tustin Avenue <br />and Fourth Street, which is a contained site surrounded by existing <br />professional and commercial developments.
