RESOLUTION NO. 2002-068 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING MINOR EXCEPTION NO 2002-03 SEEKING A REDUCTION IN OFF-STREET PARKING FOR THE PROPERTY AT 431 NORTH TUSTIN AVENUE Kdo/08/12/02 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: Minor Exception No 2002-03 came before the City Council of the City of Santa Ana for a public hearing on August 19, 2002. Minor Exception No. 2002-03 has been filed with the City of Santa Ana seeking to reduce the off-street parking requirement from 259 spaces to 254 spaces in order to construct two retail/food use buildings at 431 North Tustin Avenue. The Planning Commission of the City of Santa Ana held a duly noticed public hearing on July 22, 2002 and determined by a vote of 6:0 (Mondo absent) to recommend the City Council approve Minor Exception No. 2002- 03. D= The City Council of the City of Santa Ana hereby determines that the following findings, which must be established in order to grant a minor exception from the provisions of the Santa Ana Municipal Code, have been established: That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to depdve the subject property of privileges'not otherwise at variance with the intent and purpose of the provisions of this chapter. There are special circumstances applicable to the subject property. The subject site is located on the northeast comer of Tustin Avenue and Fourth Street, which is a contained site surrounded by existing professional and commercial developments. The number of parking spaces provided will be sufficient since the site will be used in a shared manner by the adjacent office building. Resolution No. 2002-068 Page 1 of 5
