That the granting of a minor exception is necessary for the preservation and enjoyment of one or more substantial property dghts. The granting of the minor exception is necessary to develop the property with two well-designed retail/food use building that are consistent with the General Commercial (C2) zoning district. That the granting of a minor exception will not be materially detrimental to the public welfare or injurious to surrounding property. The granting of the variance will not be materially detrimental to the public welfare or injurious to surrounding property because the proposed retail/food use buildings comply with all development standards set forth in Chapter 41 of the Santa Ana Municipal Code including setbacks and landscaping. Legdestone veneer, tile roof, awning and cornice at rooflines are proposed to accentuate the extedor elevation in order to provide consistency with the architectural styles along Tustin Avenue. That the granting of a minor exception will not adversely affect the General Plan of the City. The granting of the vadance will not adversely affect the General Plan of the City since the proposed two retail and food use buildings are designed in conformance with the C2 Zoning district development standards and General Plan requirements. Additionally, the General Plan land use designation will be amended to allow the proposed uses. The Mitigated Negative Declaration and the Mitigation Monitoring Program for Environmental Review No. 01-147 was approved and adopted with the Ordinance adopting Amendment Application No. 2002-07 which came before the City Council of the City of Santa Ana on August 19, 2002.
