That the granting of a minor exception is necessary for the <br />preservation and enjoyment of one or more substantial property <br />dghts. <br /> <br />The granting of the minor exception is necessary to develop the <br />property with two well-designed retail/food use building that are <br />consistent with the General Commercial (C2) zoning district. <br /> <br />That the granting of a minor exception will not be materially <br />detrimental to the public welfare or injurious to surrounding property. <br /> <br />The granting of the variance will not be materially detrimental to the <br />public welfare or injurious to surrounding property because the <br />proposed retail/food use buildings comply with all development <br />standards set forth in Chapter 41 of the Santa Ana Municipal Code <br />including setbacks and landscaping. Legdestone veneer, tile roof, <br />awning and cornice at rooflines are proposed to accentuate the <br />extedor elevation in order to provide consistency with the architectural <br />styles along Tustin Avenue. <br /> <br />That the granting of a minor exception will not adversely affect the <br />General Plan of the City. <br /> <br />The granting of the vadance will not adversely affect the General <br />Plan of the City since the proposed two retail and food use buildings <br />are designed in conformance with the C2 Zoning district <br />development standards and General Plan requirements. <br />Additionally, the General Plan land use designation will be amended <br />to allow the proposed uses. <br /> <br />The Mitigated Negative Declaration and the Mitigation Monitoring Program <br />for Environmental Review No. 01-147 was approved and adopted with the <br />Ordinance adopting Amendment Application No. 2002-07 which came <br />before the City Council of the City of Santa Ana on August 19, 2002. <br /> <br /> Section 2.
