05-Z9-03 07:29 FRO~-EBF CONSULTING-PLaNING DEPT. +G~983741Z2 T-707 P,OOZ/O0~ F-7ZT <br /> <br />SCOPE OF ENVIRONMENTAL SERVICES <br /> <br />'lst Street~ 5th Street, Fairview and McFadden Avenue Bridges at the Santa Aha <br />River <br /> Seismic Retrofit of Existing Bridges <br /> <br />May 29, 2003 <br /> <br />The Client and the Consultant for mutual consideration hereinafter set forth, agree that the <br />Consultant shall perform the following services for each bridge. Please note that the fee for each <br />task assumes that all four bridges and the necessary permits will be processed concurrently. <br />Should any one of the bridges be processed at a separate time as the others, RBF retains the right <br />to re-submit a revised fee schedule. <br /> <br />TASK 1,0 TECHNICAL COMPLIANCE <br /> <br />Task 1.1: Biological Review <br /> <br />A literature review will be conducted for each bridge ~o determine which species <br />have been identified as special status by state, federal, and local resources agencies <br />and organizations, and have a potential to occur within the project site or immediate <br />vicinity. Sources to be reviewed include: (1) special status species lists from the <br />California Department of Fish and Game (CDFG) and U.S. Fish and Wildlife Service <br />(USI=WS); and (2) database searches of the California Natural Diversity Database <br />(CNDDB) and the California Native Piant Societ3/s (CNPS) Electronic Inventory. <br /> <br />TASK 2.0 REGULATORY PROCESSING <br /> <br />It is our understanding that the City wishes to acquire one comprehensive set of <br />permits for each bridge location, authorizing the City to complete multiple <br />consb'uction phases under a single permit umbrella, A key element that must <br />included in the Categorical Exemption (CE) is thorough description of each <br />construction phase, providing a concrete purpose for pursuing a phase construction <br />program verses a single construction phase. <br /> <br />Our initial permitting approach will address all construction phases as defined by the <br />City, This approach assumes that the combined total permanent discharge (at each <br />bridge location) will not exceed 0.5 acre. RBF will coordinate with the appropriate <br />resource agencies to discuss the City's desired permitting approach and develop a <br />permit strategy that would meet the City's construction objectives. However, as with <br />any project which raquires authorization from the Army Corps of Engineers (ACOE), <br />the California Department of Fish and Game (CDFG), and the Regional Water <br />Quality Control Board (RWQCB), the overall permit acquisition process, mitigation <br />obligations, and phasing approach is subject to review and concurrence from the <br />aforementioned agencies. <br /> <br />Task 2.1: Site Visit to Determine Corps Jurisdiction <br /> <br />RB F will demrmine acreage considered by the Army Corps of Engineers (ACOE) and <br />the California Department of Fish and Game (CDFG)to be jurisdictional non-wetland <br />"waters of the United States." Since these areas of the Santa Ana River are <br />concrete lined, it is assumed that no Wetlands will be identified. RBF will conduct a <br />site investigation with respect to hydrology, hydrophytic vegetation (if applicable), <br />and hydric soils (if applicable). RBF will prepare a determination of the ordina ry high <br />water mark (OHWM) within the existing drainage channel <br /> <br /> Page 2 of 6 <br /> <br /> <br />
