(10%) contingency. The total amount to be expended during the entire term of said <br />Agreement shall not exceed $176,024.00, which amount includes a ten percent (10%) <br />contingency." <br />3. Section 3, TERM, shall be amended to read as follows: <br />"This Agreement shall commence on December 17, 2001 and terminate on June 30, <br />2004, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Deputy City <br />Manager for Development Services and the City Attorney." <br />4. Section 9, NOTICE, shall be amended to change Consultant's notice address to: <br />Science Applications International Corporation <br />10 East Figueroa Street <br />Santa Barbara, California 93101 <br />Telefacsimile (805) 965-6944 <br />Attn: Diane Keep <br />5. Section 16, MISCELLANEOUS PROVISIONS, shall be amended to include a new <br />subsection c., which will read as follows: <br />"Consultant certifies that it is not listed on the Federal publication of debarred, <br />suspended and ineligible contractors." <br />6. Anew Section 17, RECORD KEEPING/REPORTING, shall be added to read as <br />follows: <br />"Consultant shall keep and maintain complete and adequate records and reports to <br />assist City in meeting and maintaining its record keeping responsibilities under the <br />CDBG REGS, including the following: <br />a. Documentation of all CDBG funds received from City. <br />b. Documentation of expenses as identified in Exhibit A, including evidence of <br />incurring the expense, invoices for goods or services, copies of any and all <br />contracts or documentation pertaining to costs for subcontractors, plus all <br />other invoices for which CDBG funds were expended, and any payments <br />therefore. <br />c. Any such other related records as City shall reasonable require or as required <br />to be maintained pursuant to the CDBG REGS." <br />7. A new Section 18, SOURCE OF FUNDS, shall be added to read as follows: <br />"Consultant acknowledges that the CDBG funds being provided by City for <br />Consultant's services are received from HUD pursuant to Title I of the Housing and <br />Community Development Act of 1974, Public Law 93-383, as amended ("ACT"), <br />
