At the request of Mr. Michael, the Clerk read the n~mes of petitioners <br />favoring the variance. <br /> <br />It was moved by Councilman Burk and seconded by Councilman Brooks, that <br />Council overrule the action of the Planning Cc~mmission and grant Variance <br />2168, subject to conditions. The motion was lost on roll call vote: <br /> <br />AYES, COUNCILMEN: <br />NOES, COUNC II~N: <br />ABSENT, COUNC II~{EN: <br /> <br />Brooks, Burk <br />Gilmore, Markel, McMichael, Harvey <br />Herrin <br /> <br />It was moved by Councilman McMichael, seconded by Councilman Markel that <br />Council uphold the action of the Planning C~mmission and instruct the City <br />Attorney to prepare a resolution denying Variance 2168. <br /> <br />It w~s moved by Councilman McMichael, seconded by Councilman GiLmore and <br />carried, that the matter be referred to the Planning Department staff for <br />recommendation as to the desirability of rezoning the area. The motion <br />carried on roll call vote: <br /> <br />AYES, COUNCILMEN: <br />NOES, COUNCII~EN: <br />ABSENT, COUNCILMEN: <br /> <br />Gilmore, Brooks, Markel, McMichael, Harvey <br />Burk <br />Herrin <br /> <br />HEARING - Hearing was opened on Appeal 168 filed <br />APPEAL 168 - VA 2166 by Sidney Levin from the conditions <br /> imposed by the Pls~ning Co~ission in <br /> its approval of Variance Application <br />2166 to permit parking, damaged vehicle storage, and side yard waiver for a <br />service building at 3712 Hazard in B 2 district. The Clerk reported that <br />notice of the hearing had been mailed to adjacent property owners as required <br />by law and evidence thereof was on file; and that no written communications <br />had been received. <br /> <br />Dale Heinly, 611 W. 8th, representing the applicant, stated the Planning <br />Commission had imposed conditions on adjacent property not a part of <br />application. He suggested that applicant was willing to dedicate Harbor <br />with no improvements, dedicate Hazard to Figueroa including spandrel~ and <br />dedicate Figueroa; and asked City to impose conditions of improvement only to <br />existing pavement. The Manager stated staff's acceptance of compromise. There <br />being no further testimony, the hearing was closed. <br /> <br />On motion of Councilman Brooks, seconded by Councilman GiLmore and carried, <br />Council instructed the City Attorney to prepare a resolution granting the <br />appeal amd modifying the conditions of Variance 2166 to require dedication <br />of all areas requested and all improvements up to existing streets. <br /> <br />RECESS <br /> <br />At 9:00 p.m. the Mayor declared a five <br />minute recess. The Council reconvened <br />at 9:08 p.m. with the same Councilmen <br />present. <br /> <br />TRAFFIC HAZARD The City Manager reported regarding a <br /> communication and petition from Ed <br /> Attenborough, 2121 N. Edna Drive, asking <br /> improvements of south half of West <br />Edna Drive at Lewis; stating that a written request to the County Supervisors <br />for an easement to even out the width of the street would be submitted, and <br />if granted the street would be improved on a mini~l level to provide traffic <br />safety. <br /> <br />CITY COUNCIL <br /> <br />- 377 - <br /> <br />October ~, 1965 <br /> <br /> <br />
