The Clerk reported that a letter had been received frc~ the appellant <br />requesting that the appeal be withdrawn° <br /> <br />On motion of Councilman Herrin, seconded by Councilman Mm~kel and carried, the <br />matter was removed from the agenda. <br /> <br />C~C~IAL RABBIT YARD Council received an evaluation <br /> report from the Orange County <br /> Health Department regarding <br /> application for permit to <br />maintain rabbits at 1426 Sullivan~ submitted by Robert Do Beckwitho The report <br />indicated that with the exception of work to be done on hutches for convenience <br />of cleaning, the facilities essentially meet the provision of sub-section (a) <br />(b) and (f) of Municipal Cc(lo Section 4121.1. Council also received a petition <br />from owners and residents within approximately 300~ of the property objecting <br />to the continuance of the rabbit farm on the property~ <br /> <br />Attorney Robert Rickles, represented the applicant, stating that reguLations <br />have been met and requesting the permit be issued. Attorney John H~ Gilbert~ <br />Jr., representing Mr. Hubert Melton, 14~6 So Sullivan~ one of the opponents, <br />stated that the use causes excessive flies and odors; devaluates nearby property, <br />and is a nuisance° The Planning Director stated there was a question as to <br />whether or not a prior non-conforming use ha~ been maintained continuously° <br /> <br />On motion of Councilman McMichael, seconded by Councilman Brooks ami c~rried, <br />the matter was continued to June 20~ 1966 and the staff requested to investigate <br />and report back with a recummen~ation. <br /> <br />APPEAL 176, VA 66-31 Hearing was opened on appeal filed <br /> by Walter R. Giles and John Bre~er <br /> of the Planning Commission's approval <br /> of Variance Application 66-31 filed <br />by William Moss to construct a 6' high fence in required front yard at 94~ W. <br />Buffalo. The Clerk reported that notice of hearing was mailed to adjacent property <br />owners May 31, 1966 and evidence thereto was on file.
