Dale Heinly, attorney for applicant, described the area, the proposed <br />small market use, noting design as compatible with residential neigh- <br />borhood and commented on the 80' primary streets. He cited other markets <br />in area and requested air conditioning and refrigeration equipment be <br />allowed on top of building if variance granted. <br />Wesley Ulrich, 1110 S. Garnsey, spoke in opposition, Speaking in favor <br />of the application were Doug Faulkner, Roland Witherow, 813 W. McFadden, <br />and Ray Shirley. <br />A petition in opposition, with 65 signatures, was ordered filed as a <br />part of the hearing, on motion of Councilman Gilmore, seconded by <br />Councilman Brooks and carried. <br />The Planning Director explained that a study of neighborhood markets <br />would be completed in January but the applicant had asked the Commission <br />to act on this application. There being no further testimony, the <br />hearing was closed. <br />On motion of Councilman Burk, seconded by Councilman Herrin, Council <br />overruled the decision of the Planning Commission and approved the <br />variance, subject to conditions set out in Staff Comments,dated 11/14/66, <br />with no exceptions. On roll call vote; <br />AYES: Councilmen Gilmore, Brooks, Burk, Herrin, Harvey <br />NOES: Councilman McMichael <br />ABSENT: Councilman Markel <br />.r PARCEL MAP 490 On motion of Councilman Herrin, <br />seeded by Councilman Brooks <br />and carried, Council approved <br />Parcel Map 490, filed by Minter, at al, creating two parcels at the <br />northeast corner of Bristol and Memory Lane, subject to conditions in <br />report dated November 30, 1966, with added condition requiring standard <br />City street lights, and waived alley requirement. <br />PARCEL MAP 491 On motion of Councilman Herrin, <br />seconded by Councilman Brooks <br />and carried, Council approved <br />Parcel Map 491, filed by Tubbs, creating two parcels south and east of <br />the intersection of Fourth and Tustin, subject to conditions in report <br />dated 11/3o/66 with added condition requiring standard City street <br />lights, and waived alley requirement. <br />PRELIMINARY RECORD OF SURVEY 383 On motion of Councilman Herrin, <br />seconded by Councilman Brooks <br />and carried, Council approved, <br />as recommended in Planning Report dated 11/29/66s change in Condition, <br />D. 3 imposed by Council in its approval of Preliminary Record of <br />Survey 383 on 22/12/64, regarding private cul-de-sac street. <br />a,t SOLICITATIONS On motion of Councilman Brooks, <br />seconded by Councilman Gilmore and <br />carried, application of Calvary <br />United Association of Santa Ana for public solicitation with gum stickers, <br />12/15/66 - 2/15/67, was approved. <br />CITY COUNCIL -64- December 5, 1966 <br />
