Dale Heinly, attorney for applicant, described the area, the proposed
<br />small market use, noting design as compatible with residential neigh-
<br />borhood and commented on the 80' primary streets. He cited other markets
<br />in area and requested air conditioning and refrigeration equipment be
<br />allowed on top of building if variance granted.
<br />Wesley Ulrich, 1110 S. Garnsey, spoke in opposition, Speaking in favor
<br />of the application were Doug Faulkner, Roland Witherow, 813 W. McFadden,
<br />and Ray Shirley.
<br />A petition in opposition, with 65 signatures, was ordered filed as a
<br />part of the hearing, on motion of Councilman Gilmore, seconded by
<br />Councilman Brooks and carried.
<br />The Planning Director explained that a study of neighborhood markets
<br />would be completed in January but the applicant had asked the Commission
<br />to act on this application. There being no further testimony, the
<br />hearing was closed.
<br />On motion of Councilman Burk, seconded by Councilman Herrin, Council
<br />overruled the decision of the Planning Commission and approved the
<br />variance, subject to conditions set out in Staff Comments,dated 11/14/66,
<br />with no exceptions. On roll call vote;

<br />NOES: Councilman McMichael
