SURPLUS PROPERTY SALE &% ~ The Mayor announced the sale of real <br /> property described in Report 14-67 <br /> consisting of one parcel 125 ft. x 48 <br />ft. (6,000 square feet) at 412-~1~ Eastwood, at a minimum price of $15,000.00. <br /> <br />The Clerk reported that no sealed bids had been received. The Mayor called <br />for oral bids. Maurice O'Connor, Attorney representing Southern Service <br />Company, submitted a bid of $15,000.00, with a letter stating the following <br />conditions: (1) That the City grant a perm.-nent change of zone on the sub- <br />Ject property from R 3 to C 2; (2) That the cc~pany have the right to inspect <br />the covenants, conditions and restrictions of record against the property and <br />the written approval of said encumbrances by the company shall be required as <br />a condition of the sale; (3) That either the improvements on the property be <br />removed by the City at City expense, or that said improvements be permitted to <br />remain on the property for use by ~he Compauy. <br /> <br />After some discuss/on regarding the conditions set out in Southern Service <br />Company's proposal, and after a conference between Mr. O'Connor and the City <br />Attorney, Mr. O'Connor stated that Southern Service Company would agree to <br />removing the second and third conditions set out in their letter, and would <br />be willing to purchase the property under the City's Conditions of Sale, <br />subject to rezoning of the property to C 2. <br /> <br />Mayor McMichael called for additional bids. After three calls with no response, <br />the property was declared sold for $15,000.00 to Southern Service Company, <br />subject to cb--ge of zone to C 2 and the requirements set out in "Information <br />to Bidders". <br /> <br />~. APP. 606 ~*~ ~: ~ Hearing was opened on Amendment Appli- <br />COLE cation 606 filed by Margery Cole, contin- <br /> ued from July 3rd meeting, proposing <br />amendment of Sectional District Map 10-5-10 to reclassify property on the <br />east sid~ of Nar~or between Washington and 17th from C 2 an~ R 2 to the <br />M i District. Planuing C~m~tssion recommended denial. <br /> <br />Dale Heinly, Attorney representing Ralph Mitzel, explained to the Council <br />his client had no objection to the requirement that Bewley Street be a cul- <br />de-sac, they would dedicate all access rights t~ Bewley Street for they <br />intended to use Harbor Boulevard for access; they were willing to have a <br />strip on the southerly and easterly side zoned R 2 B which will limit the <br />use of that property to parking protecting the property owners to the South <br />and easts client would put in block wall fencing on south and on the east <br />where there isn't any now; would put in. chath link fenCing on the ~north which <br />adjoins N 1 proparty. '. <br /> <br />After hearing report of Senior Planner, the bearing was closed, there being <br />no f~r~her testimony. <br /> <br />Council discussed the possibility of a variance rather than zone change which <br />would lfmtt the use timewise, and wouldmake certain that propose~ conditions <br />would be assured, but Mr. Heinly explained his client is in an escrow conditioned <br />on zont~. <br /> <br />It was moved by Councilman Carlson~ seconded by Councilman Herrin, to approve <br />the reclassification to M 1 zoning except the southerly 50 feet and the east- <br />erly 50 feet of boundaries, reclassifying them to R 2 B; and instruct the <br /> <br />CITY CODNCIL 2~3 July 17, 1967 <br /> <br /> <br />
