If the employee later <br />sues you In your capacity as a <br />manufacturer, allegIng that the injury <br />happened because your product was <br />defective, we wortt pratect you, <br /> <br />We'll .'so apply this exclusion to any <br />obligation of the protected person to shllre <br />damages with or repay someone else who <br />must pay damages because of bodily Injury <br />to any employee of the protected person. <br />For exllmple: <br /> <br />Your employee is injured In an injection <br />molding machine accident. That employee <br /> <br />NO. 293 <br /> <br />P.21/31 <br /> <br />receives workers compensi1t;on benefits. <br />Later, the employee sues the manufacturer <br />of the injection molding machine alleging <br />that the injury happened because it didn't <br />have enough guarding devIces on it. If the <br />manufacturer in turn sues you, alleging that <br />your faulty maintenance of the machine. not <br />the lack of guarding dwkes, resulted in <br />the employee's injury, we won't protect <br />you. <br /> <br />But we won't IIpply this exclusion to the <br />liability of another to pay damages for <br />bodily injury If you hllve assumed such <br />liability under a covered contract made <br />before the bodily injury happens. <br /> <br />We expl!lin the terms: <br /> <br />. covered contract in the Contract liability <br />exclusion; and <br /> <br />. employee in the Employees and volunteer <br />workers section. <br /> <br />Employment-related practices, We won't cover <br />personal injury to any protected person's <br />employee, prospective or former employee, <br />leased temporary worker, or independent <br />contractor that results from any <br />employment-related practices, For e¡o;ample: <br /> <br />You terminate an employee for falsifying <br />business travel expenses. You explain the <br />reason for the termination of that employee <br />to one of your customers.
