`IN ,'!1RAA ON FILE <br />WINK MAY PROCEED <br />U4 TIL INSURANCE EXPIRES <br />CLERK OF COUNCIL <br />DATE: <br />G' N Iry <br />(5. p0m) <br />A- 2003 -127 <br />/„ 2 :3d-_ 3 FIRST AMENDMENT TO CONSULTANT AGREEMENT <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />this / day of,_rtc , 2003, by and between Camp Dresser & McKee, <br />Inc., a California corporation ( "Consultant ") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ( "City "). <br />RECITALS: <br />A. The parties entered into Agreement #N- 2003 -055, dated May 21, 2003, (hereinafter <br />"said Agreement ") by which Consultant has assisted the City in obtaining grant <br />funding and preparing a local implementation plan for the City's storm -water <br />management program. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Scope of Services and increase the compensation to pay for the additional <br />services to be provided by Consultant. <br />WHEREFORE in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Consultant Agreement, the parties agree as follows: <br />1. The Scope of Services shall be amended to include the grant funding and local <br />implementation plan tasks set forth in Exhibit A, attached hereto. <br />2. Consultant shall perform services and accept payment as set forth in Exhibit A of this <br />First Amendment. The total compensation to be expended shall be increased by <br />$42,300.00 for a total amount, which shall not exceed $52,300.00 during the term of <br />said Agreement. <br />3. Except as hereinabove modified, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to <br />Consultant Agreement on the date and year first written above. <br />ATTEST: <br />PATRICIA E.
