AMENDMENT NO. 2 TO COOPERATIVE <br />PROJECTS PROGRAM CONTRACT NO. 0016 <br /> <br /> THIS AMENDMENT NO. 2 to COOPERATIVE PROJECTS PROGRAM <br />CONTRACT NO. 0016, is made and entered into, to be effective this~_.~_ d~aay of <br />.~0~ ~)~F', 2002, by and between: <br /> <br /> ORANGE COUNTY SANITATION DISTRICT, <br /> hereinafter referred to as "DISTRICT"; <br /> <br />AND <br /> <br />CITY OF SANTA ANA, hereinafter referred to <br />as "AGENCY". <br /> <br /> RECITALS <br /> <br /> WHEREAS, on November 6, 2000, DISTRICT and AGENCY entered into <br />a Cooperative Projects Program Contract ("Original Contract"), in connection with <br />DISTRICT's Cooperative Project Program; and <br /> <br /> WHEREAS, on July 30, 2002, DISTRICT and AGENCY executed <br />Amendment No. 1 to Cooperative Projects Program Contract, for purposes of <br />extending the completion date in the Original Contract an additional six (6) <br />months, up to and including August 20, 2002; and <br /> <br /> WHEREAS, the terms and conditions of both the Original Contract and <br />Amendment No. 1 will expire prior to the project completion, due to unforeseen or <br />unavoidable circumstances; and <br /> <br /> WHEREAS, DISTRICT and AGENCY mutually desire to further extend the <br />term of the Original Contract and Amendment No. 1, in order to allow AGENCY <br />to complete the project; and <br /> <br /> <br />
