WHEREAS, pursuant to the terms of the Original Contract, any extension <br />beyond six (6) months shall be approved by DISTRICT's Board of Directors. <br /> <br /> NOW, THEREFORE, in consideration of the foregoing, it is agreed <br />between the Parties hereto as follows: <br /> <br /> Section 1: Paragraph 4 of the Original Contract, dated November 6, <br />2002, is hereby amended in full to read as follows: <br /> <br /> "The term of this Contract is from August 20, 2002, which is the <br /> project completion date in Amendment No. 1, through completion of <br /> the project, or June 30, 2003, whichever occurs first, unless <br /> terminated earlier as provided for in Paragraph 5 of the Original <br /> Contract entitled 'Termination'. All project deliverables and <br /> requests for reimbursement must be received by July 28, 2003. <br /> Any extension beyond ten (10) months shall be approved by <br /> DISTRICT's General Manager provided the time extension is <br /> related to flow monitoring delays due to lack of rain. Extensions for <br /> any other reason shall be approved by the DISTRICT's Board of <br /> Directors." <br /> <br /> Section 2: Except as modified herein, all other terms and <br /> <br />conditions of the Original Contract shall remain in full force and effect. <br /> <br />2 <br /> <br /> <br />
