The subdivision is also in <br />compliance with Chapter 34 of the Santa Ana Municipal <br />Code, which governs the subdivision of property and the <br />California Subdivision Map Act. In addition, Covenants, <br />Conditions and Restrictions (CC&Rs) addressing drainage, <br />reciprocal access, landscaping and maintenance will be <br />recorded prior to approval of the final map. <br /> <br />The project site is physically suitable for the type and density of the <br />proposed project. <br /> <br />The site is rectangular in shape and is approximately 3.53 <br />acres in size, with approximately 330 linear feet of frontage <br />on Dyer Road. The site is physically suitable for industrial <br />development. There are no physical constraints on the site <br />that would preclude industrial development on the property. <br />Access to the site is from Dyer Road. Future development <br />will comply with all provisions of the City's zoning code and <br />will not exceed the 0.45 FAR allowed by the City's General <br />Plan. ' <br /> <br />4. <br /> <br />The design and improvements of the proposed project will not <br />cause substantial environmental damage or substantially and <br />avoidably injure fish and wildlife or their habitat. <br /> <br />In accordance with the Califomia Environmental Quality Act <br />(CEQA), the project is exempt from further review. The <br />project site is located in an urbanized area. There are no <br />known fish or wildlife populations, wetlands or unusual flora <br />or fauna on or around the project site. Therefore, the <br />proposed subdivision will riot cause any substantial <br />environmental damage or substantially and avoidably injure <br />fish and wildlife or their habitat. <br /> <br />5. <br /> <br />The design or improvements of the proposed project will not cause <br />serious public health problems. <br /> <br />The proposed subdivision will not have any detrimental <br />effects upon the general public~ Each property will meet the <br />City's requirements pertaining to sewer, water utilities and <br />infrastructure improvements as conditioned in Development <br />Project Review No. 2003-43. <br /> <br />6. <br /> <br />The design or improvements of the, proposed project will not conflict <br />with easements necessary for public access through or use of the <br />property within the proposed project. <br /> <br />328..13 <br /> <br />Resolution No. 2004-05 <br />Page2of5 <br />
