<br />'~.' <br /> <br />) <br /> <br />1. <br /> <br />Public Agencies <br /> <br />2. <br /> <br />Public Educational Institutions <br /> <br />3. <br /> <br />All other institutions as determined by Grantor <br />in the following categories: health care <br />facilities, senior citizen meeting facilities <br />open to public use except religious organi- <br />zations and parochial or private non-profit <br />educational facilities. <br /> <br />SECTION 9. <br /> <br />PURCHASING, TRAINING AND EMPLOYMENT REQUIREMENTS <br /> <br />9.1 Local Purchasing and Hiring policy. Grantee shall <br />establish a policy of employing City residents within its own <br />operations, and of utilizing City-based firms for purchases <br />and construction subcontracts, to the maximum extent possible. <br />Grantee shall provide Grantor with a written report of local <br />purchasing and hiring achievements at least annually for the <br />duration of the franchise. <br /> <br />9.2 Equal Employment Opportunity and Affirmative Action <br />Programs. Throughout the term of the franchise, Grantee <br />shall conduct its business as an Equal Employment Opportunity/ <br />Affirmative Action Employer. In addition, throughout the <br />term of the franchise, Grantee shall maintain a policy that <br />all employment decisions, practices, and procedures are based <br />on merit and ability without discrimination in violation of <br />state or federal law on the basis of an individual's race, <br />color, creed, relition, age, sex, national origin, marital <br />status, or physical or mental handicap except as provided by <br />law. Grantee's policy shall apply to all employment actions <br />including advertising, recruiting, hiring, promotion, transfer, <br />remuneration, selection for training, company benefits, dis- <br />ciplinary action, lay-off or termination. Grantee shall <br />carry out this policy through continued dedication to a de- <br />termined and sustained effort to provide equal employment <br />opportunities to all by taking affirmative action to employ <br />and advance in employment qualified women, minorities, persons <br />who are physically or mentally handicapped, and veterans. <br />Grantee shall provide to Grantor's City Manager a written <br />Affirmative Action Program to carry out this policy no later <br />than ten (10) days prior to the date Grantee accepts this <br />franchise. <br /> <br />9.3 Employment Training Programs. Grantee shall, during <br />the entire term of the franchise, conduct an aggressive training <br />program to train local residents, particularly the unskilled <br />and semi-skilled, for employment in the cable industry. <br /> <br />-32- <br />
