<br />COUNTY, CONTRACTOR assures, with respect to operation of all programs or activities funded with funds <br /> <br />provided pursuant to the Act, and all agreements or arrangements to carry out such programs or activities, that it <br /> <br />will comply fully with the nondiscrimination and equal opportunity provisions of the Act (Section 188); the <br /> <br />Nontraditional Employment for Women Act of 1991; Title VI of the Civil Rights Act of 1964, as amended; section <br /> <br />504 of the Rehabilitation Act of 1973, as amended; the Age Discrimination Act of1975, as amended; the Americans <br /> <br />with Disabilities Act of 1990; Title IX of the Education Amendments of 1972, as amended; and with all applicable <br /> <br />requirements imposed by or pursuant to regulations implementing those laws, including, but not limited to, 29 <br /> <br />C.F.R. Part 37. The United States, the State of California and COUNTY have the right to seek judicial enforcement <br /> <br />of this assurance. <br /> <br />(2) CONTRACTOR will comply with the provisions of the Fair Employment and Housing Act <br /> <br />(California Government Code, Section 12900 et seq.) and the regulations promulgated thereunder (California Code <br /> <br />of Regulations, Title 2, Section 7285.0 et seq.). The applicable regulations of the Fair Employment and Housing <br /> <br />Commission implementing Government Code Section 12990 (a-f), set forth in Chapter 5 of Division 4 of Title 2 of <br /> <br />the California Code of Regulations are incorporated into this Agreement by reference and made a part hereof as if set <br /> <br />forth in full. <br /> <br />(3) During the performance of this Agreement, CONTRACTOR and its subcontractors will not <br /> <br />deny the Agreement's benefits to any person on the basis of race, ancestry, national origin, religion, color, ethnic <br /> <br />group identification, sex, age, mental or physical disability (including HIV and AIDS), medical condition (cancer), <br /> <br />marital status, denial offamily care leave, political affiliation or belief, nor will they unlawfully discriminate, harass <br /> <br />or allow harassment against any employee or applicant for employment because of race, ancestry, national origin, <br /> <br />religion, color, ethnic group identification, sex, age, mental or physical disability (including HIV and AIDS), <br /> <br />medical condition (cancer), marital status, denial òf family care leave, political affiliation or belief.
