NS-1000 - KENNEL The City Council considered Agenda <br />REQUIREMENTS AND It em 7, Ordinance NS-1000, and Agenda <br />RES~ 70-3 - VA 69-86 Item 16, Resolution 70-3, held over to <br /> the evening meeting from the afternoon <br />Agenda, The City Attorney stated that he had met with Mrs. Henry, owner of <br />Flormars' Kennels, to discuss the proposed ordinance, Ordinance NS-1000, <br />which deletes from the Code the provision that would make it unlawful to main- <br />tain an established kennel within 300 feet or 200 feet (depending on the number <br />of dogs) of a residential deve!oprnent. He also explained that the kennel people <br />would like to have the entire ordinance revised and that his office is presently <br />contemplating a comprehensive revision of all kennel provisions, since the <br />present Code provisions are inadequate that the ordinance now being considered <br />would also be subject to revision at that time; that it is an interim measure at <br />this time to allow the Flomar's Kennels to remain in operation~ The City <br />Attorney further stated that he had also talked with Mr~ Morgan, applicant for <br />Variance Application 69-86, and that he had indicated that he proposed to con- <br />struct covered carports having rafters along the top which will join the top of <br />the wall on the property line adjacent to the kennels; and that the wall would <br />have a height of 8 1/2 feet and would be either stucco or cement block wall, <br /> <br />The Mayor recognized Robert Harr, who requested Council reconsider its <br />action taken to uphold the Planning Commission's decision in granting Variance <br />Application 69-86 to Marshall Morgan for construction of apartments adjacent <br />to the kennels. He stated that the 8 1/2 foot wall height ,~vould not be a high <br />enough barrier to alleviate the noise from the apartments which would excite <br />the dogs, and the dogs' barking would bother the tenants. Fredda Sortray, <br />828 East Normandy, also expressed concern for the kennels operation, <br /> <br />After discussion by Council, ORDINANCE NS-1000 ANIENDING CHAPTER 5 <br />OF THE SANTA ANA MUNICIPAL CODE BY AMENDING SECTION 5-64 OF <br />ARTICLE II THEREOF PERTAINING TO KENNEL REQUIREMENTS was <br />adopted, on motion of Councilman Patterson, seconded by Councilman tterrin, <br />on the following roll call vote: <br /> <br />AYES: Herrin, Evans, Markel, <br />NOES: None <br />ABSENT: None <br /> <br />Patterson, Villa~ Yamamoto, Griset <br /> <br />On motion of Councilman Patterson, seconded by Councilman Villa and carried, <br />with Councilman Yamamoto abstaining, Council reconsidered ~ts action taken <br />on January 5 to deny the appeal filed in connection with the granting of Variance <br />Application 69-86 and set the matter for a re-hearing before the City Conncii on <br />February 2, 1970, at 7:30 P, M~ ~ in the Council Chamber.~ City Hall 3knnex. 500 <br />West Sixth Street, Santa Ana.
