EMINENT DOMAIN Acting on the City Attorney' s recommen- l,~' <br /> dation regarding the request from Townsend <br /> Company, Cherry Rivet Division, for <br />initiation of eminent domain proceedings to acquire a public easement generally <br />located between the Southern Pacific Railroad track and Emmett Street, the <br />Council made a finding that the public interest requires that the drainage be <br />improved in the subject area and that an easement should be acquired by the <br />City in the event the property owner is unable to conclude satisfactory negotia- <br />tions, on motion of Councilman Patterson, seconded by Councilman Villa, on <br />the following roll call vote: <br /> <br />AYES: Evans, Patterson, Villa, Yamamoto, Griset <br />NOES: He rrin, Markel <br />ABSENT: None <br /> <br />MOBILE HOME PARKS The Council considered the City Manager's <br /> report dated February 25, 1970, regarding <br /> Planning Commission Resolution 5912, <br />governing guiding the design of Mobile Home Parks. Following discussion, it <br />was moved by Councilman Patterson, seconded by Councilman Evans and unani- <br />mously carried, to instruct the City Attorney to draft an ordinance adopting the <br />substance of Planning Commission Resolution 5912. <br /> <br />AGENDA Agenda ilems 49, 50, 51 and 52 were <br /> held over until the evening meeting on <br /> motion of Councilman Herrin, seconded <br />by Councilman Villa and unanimously carried. <br /> <br />APARTMENT LICENSE FEE The Mayor recognized Mr. Hal Davis, <br /> 1201 South Bristol Street, who stated <br /> that he owns and manages 88 apartments <br />within the City; that on February 20, 1970, he received a letter from the City <br />Attorney's office informing him that he owed the City $528 in unpaid business <br />license fees for the years 1967, 1968 and 1969; and that the total amount now <br />due the City, including the 1970 license fee, was $704. He furiher stated that <br />he had contacted many real estate brokers and apartment house owners and <br />managers and had yet to find anyone who knew about this license fee Or who is <br />paying it; that it might be legally right but it was morally wrong to make a <br />demand for the three-years previous payment when he had known nothing about <br />tb.e license requirement until he had received the City Attorney's letter. <br /> <br />The City Attorney stated that the matter had been brought to his attention in <br />1969 for necessary legal action; that the record indicated that notices had <br />been forwarded to Mr. Davis at 1201 South Bristol on several occasions; and <br />that a legal action had been brought against Mr. Davis which would preclude <br />council action in the matter at this time. <br /> <br />CITY COUNCIL -59- March 2, 1970 <br /> <br /> <br />
