<br />One Broadway Plaza <br />Environmental Impact Report <br /> <br />Findings and Facts in Support of Findings <br /> <br />The proposed project will not have a substantial adverse effect on federally protected wetlands as <br />defined by Section 404 of the Clean Water Act (including but not limited to, marsh, vernal pool, <br />coastal, etc.) through direct removal, filling, hydrological inteITUption or other means because there <br />are no wetlands on the project site. <br /> <br />The proposed project will not interfere substantially with the movement of any native resident or <br />migratory fish or wildlife species or with established native resident or migratory wildlife corridors, <br />or impede the use of native wildlife nursery sites because there are no dispersion corridors or <br />nursery sites on or adjacent to the project site. <br /> <br />The proposed project will not conflict with any local policies or ordinances protecting biological <br />resources, such as a tree preservation policy or ordinance because there are no significant biological <br />resources to protect on the site. The project proponent will also replace significant trees removed <br />from the site with new trees planned as part of the project landscaping. <br /> <br />The proposed project will not conflict with the provisions of an adopted Habitat Conservation Plan, <br />Natural Community Conservation or other approved local, regional or state habitat conservation <br />plan because there are no such plans for the project site. <br /> <br />4.3.4 Cultural Resources <br /> <br />The proposed project will not directly or indirectly destroy a unique paleontological resource or site, <br />or unique geologic feature because there are no paleontological resources or unique geological <br />features on the project site. <br /> <br />4.3.5 Geology and Soils <br /> <br />The proposed project would not expose people or structures to potential substantial adverse effects, <br />including the risk of loss, injury or death involving: <br /> <br />1. <br /> <br />Rupture of a known earthquake fault, as delineated on the most recent Alquist-Priolo <br />Earthquake Fault Zoning Map issued by the State Geologist for the area or based on other <br />substantial evidence of a known fault because there are no faults on the project site. <br /> <br />iii. Seismic-related ground failure, including liquefaction because there are no liquefiable soils on <br />the project site. <br /> <br />iv. Landslides because the project site is flat and not subject to landslides. <br /> <br />The proposed project will not result in substantial soil erosion or the loss of topsoil because standard <br />measures will be taken to prevent soil loss from the project site during construction. <br /> <br />The proposed project will not be located on a geologic unit or soil that is unstable, or that would <br />become unstable as a result of the project, and potentially result in on- or off-site landslide, lateral <br /> <br />U/vfregoso/wp51/reports/One Broadway final findings <br />June 28,2004 <br /> <br />Page 40 <br />
