<br />Private Disposition and Development Agreement <br /> <br />This Private Disposition and Development Agreement ("DDA'') is entered into on this 19th <br />day of July, 2004 by and between the COMMUNITY REDEVELOPMENT AGENCY OF THE <br />CITY OF SANTA ANA, a public body corporate and politic ("Agency"), and DONALD J. <br />CREVIER, AS TRUSTEE OF TIlE DONALD CREVIER TRUST, and CREVIER MOTORS, <br />INC., a California corporation (collectively referred to herein as "Developer"). <br /> <br />For good and valuable consideration stated herein, the receipt and sufficiency of which are <br />hereby acknowledged, the Agency and the Developer agree as follows: <br /> <br />ARTICLE I - SUBJECT OF AGREEMENT <br /> <br />Section 101. Purpose of the Agreement <br /> <br />The purposes of this DDA are to: <br /> <br />(a) effectuate the Redevelopment Plan, specified in Section 102 of this DDA, by <br />providing for the rehabilitation and redevelopment of a portion of the South Main Project Area; <br /> <br />(b) provide for the construction of the following on approximately 4.23 acres currently <br />owed by Agency and 5.1 I acres owned by Developer (hereafter collectively referred to as "the <br />Project"); <br /> <br />(i) two new, modern, attractive showrooms, one for the sale and lease of new <br />automobiles and the other for the sale and lease of previously owned automobiles, both of <br />which meet the requirements of SD 60; <br /> <br />(ii) a modern, attractive, five (5) story parking structure with approximately <br />730 parking spaces which meets or exceeds the pertinent design standards as set forth in <br />the (A) SD 60, and (B) Santa Ana Design and Development Standards for Parking <br />Structures; <br /> <br />(iii) a rehabilitated showroom for sale and lease of new automobiles (of a <br />different make than the showroom referenced in section 10 I (b )(i), above~ <br /> <br />(iv) a rehabilitated and expanded repair facility for automobiles; and <br /> <br />(v) ancillary support activities, such as a detailing center and carwash; <br /> <br />(c) implement SD 60 as amended, adopted by the City of Santa Ana; <br /> <br />1 <br />
