<br />include all improvements referenced in section 101 (b) above, which improvements are <br />hereinafter collectively referred to as the "Project." <br /> <br />Section 302. Public Improvements <br /> <br />Developer shall be responsible for the zoning, costs of environmental documents and all <br />other municipal requirements, which shall be such as to permit development of the Property and <br />the construction, use, operation, and maintenance of the improvements to be constructed thereon <br />in accordance with the provisions of this DDA. The Developer shall be responsible for obtaining <br />any approvals required by any agency, department or bureau having jurisdiction over the <br />development or the Developer. The Developer acknowledges and agrees that these City of Santa <br />Ana approvals will include, but not be limited to, the condition that Developer dedicate and <br />improve a portion of its property for a dedicated right turn lane southbound on Auto Mall Drive. <br /> <br />Section 303. Responsibilities ofthe Agencv <br /> <br />The Agency shall perform only that work explicitly specified in the Scope of <br />Development and elsewhere in this DDA for the Agency to perform. <br /> <br />Section 304. <br /> <br />Preliminary Plans <br /> <br />A. All work to be performed on the Property shall be in accordance with the <br />Preliminary Plans and related documents approved by the Agency at the time of its approval of <br />this DDA, except for such changes which may be mutually agreed upon in writing between the <br />Developer and the Agency. Any such changes may be approved by Agency's Executive Director <br />provided they are within the limitations established in the Scope of Development. A reduced <br />copy of the Preliminary Plans as approved by the Agency at the time of its approval ofthis DDA <br />is attached hereto as "Attachment No.4". <br /> <br />B, The Project shall be developed in three (3) Phases as set forth in the Preliminary <br />Plans. In general, Phase I shall be the parking garage and re-sale showroom, Phase II shall be <br />the construction of the new sales showroom and Phase III shall be the expansion of the service <br />area and rehabilitation ofthe existing new sales showroom. <br /> <br />Section 305. Landscaping Plans <br /> <br />Landscaping plans shall be those approved by the City as part of Design Review <br />No.2004-002. <br /> <br />-~ <br /> <br />Section 306. <br /> <br />Construction Drawings and Related Documents <br /> <br />A. <br /> <br />The Developer shall prepare and submit construction drawings and related documents for <br />the Property to the Agency for review (including, but not limited to, architectural review) <br />and written approval as and at the times established in the Schedule of Performance. <br />The construction drawings and related documents shall be submitted in two stages: (i) <br /> <br />6 <br />
