<br />bk: 7/14/04 <br /> <br />RESOLUTION NO. 2004-056 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA MODIFYING CONDITIONAL USE PERMIT <br />NO. 2002-16 AS CONDITIONED TO ALLOW <br />CONSTRUCTION OF A CATHEDRAL WITH <br />UNDERCROFT ON THE PROPERTY LOCATED AT 2001 <br />WEST MACARTHUR BOULEVARD <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. <br /> <br />Conditional Use Permit No. 2002-16 was approved by the City Council of <br />the City of Santa Ana ffollowing a duly noticed public hearing on October <br />7,2002. A request to modify said Conditional Use Permit came on for a <br />duly noticed public hearing on July 19, 2004. <br /> <br />The request to modify Conditional Use Permit No. 2002-16 has been filed <br />with the City of Santa Ana by the Roman Catholic Diocese of Orange (The <br />Roman Catholic Bishop of Orange) to allow the construction of a 45,000 <br />square foot undercroft in conjunction with the Christ Our Savior Cathedral <br />Parish at 2001 West MacArthur Boulevard. <br /> <br />B. <br /> <br />C. <br /> <br />The Planning Commission of the City of Santa Ana held a duly noticed <br />public hearing on June 28,2004, on Conditional Use Permit No. 2002-16 <br />and voted by a vote of 7:0 to recommend that the City Council approve the <br />modification of Conditional Use Permit No. 2002-16 as conditioned. <br /> <br />D. <br /> <br />Santa Ana Municipal Code Section 41-638 authorizes the City Council to <br />grant a conditional use permit upon making certain findings. <br /> <br />1. <br /> <br />That the granting of a Conditional Use Permit is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights. <br /> <br />The Christ Our Savior Cathedral Parish and undercroft, as <br />conditioned, will contribute to the general welfare of the <br />community by providing a religious facility that is not <br />currently found in the area. <br /> <br />2. <br /> <br />Will the proposed use under the circumstances of the particular <br />case be detrimental to the health, safety or general welfare of the <br />persons residing or working in the vicinity? <br /> <br />75C-36 <br />
