LEASED HOUSING PROGRAM <br />SECTION 23 - (Continued) <br /> <br />The majority of the Council felt that definitive action in establishing the <br />Leased Housing Program and the Housing Authority has been taken; but <br />requested that the Real Estate Corporation continue their study and give <br />the Housing Authority the benefit of its expertise. <br /> <br />Councilmen Evans and Herrin suggested that the matter should be referred <br />for vote of the people. The Ciiy Attorney stated that the Attorney General <br />has ruled that Leased Housing programs do not require a referendum. <br /> <br />Further discussion concerned the right of Councilmen to refuse to act <br />on the Housing Authority due to their strong opposition to the program. <br />Councilman Herrin stated that when he was elected to the City Council, <br />his responsibility was strictly in matters of policy; that the Housing <br />Authority will be required to act in matters of administration. Councilman <br />Villa stated that in appointing itself as the I-lousing Authority, the City <br />Council still remains a policy making body; that administrative matters <br />can be turned over to a staff. The City Attorney stated that in accepting <br />the office of Councilman, a Council member swears to Uphold the laws <br />of the State and City, and is forbidden from abstaining from any vote <br />except in the case of Conflict of Interest. <br /> <br />Councilman Villa's motion, seconded by Councilman Patterson, to direct <br />the staff to prepare and submit an application for an initial allocation of <br />250 units of Section 23 Leased Housing to the U.S. Department of Housing <br />and Urban Development, with the allocation to consist of 50 units of housing <br />for the elderly and 200 units of family-type housing, carried on the following <br />roll call vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Villa, Patterson, Griset, Yamamoto <br />Evans, Herrin, Markel <br /> None <br /> <br />FIRST STREET PROPERTIES Councilman Markel requested <br /> a report in writing from <br /> the City Attorney showing <br />the status of First Street properties subject to eminent domain proceedings. <br /> <br />CITY COUNCIL <br /> <br />-268 - <br /> <br />August 2~ 1971 <br /> <br /> <br />
