PUBLIC HEARING <br />CUP 71-17 - ERNEST & LILLIAN CAPP - (Continued) <br /> <br />A petition with 17 signatures of residents in the area opposed to the CUP <br />was received and filed on the unanimously approved motion of Councilman <br />Herrin, seconded by Councilman Markel. <br /> <br />Frances Griswald, 1638 E. Palm, opposed the granting of the Permit, stating <br />that it would add to the noise in the area; and that it wound not be a good use <br />for that neighborhood. <br /> <br />Gordon Bricken, 1017 North Wright, member of the Planning Commission <br />who abstained from voting when the matter was before the Commission, <br />explained for the record that this was due to the fact that he had been called <br />out of the meeting at the beginning of the hearing and had not had the <br />opportunity of hearing the testimony presented. <br /> <br />There were no other proponents or opponents and the Mayor declared the <br />hearing closed. <br /> <br />It was moved by Councilman Herrin, seconded by Councilman Villa to <br />uphold the decision of the Planning Commission and to instruct the City Attorney <br />to prepare a Resolution granting Conditional Use Permit No. 71-17, subject to <br />conditions of approval contained in the Commission report. <br /> <br />Councilman Yamamoto's motion to amend the main motion by providing an <br />additional condition, to limit the enrollment of children at the school to a <br />maximum of 60, was seconded by Councilman Evans and carried on the following <br />roll call vote: <br /> <br />AYES: Yamamoto, Patterson, Markel, Villa, Evans, Herrin, <br />NOES: None <br />ABSENT: None <br /> <br />Griset <br /> <br />The Main motion was approved on the following roll call vote: <br /> <br />AYES: Herrin, Griset, Yamamoto, Markel, V, illa, Evans <br />NOES: Patterson <br />ABSENT: None <br /> <br />RECESS <br /> <br />all Council members present. <br /> <br />At 8:50 P.M., a ten-minute recess <br />was declared. The meeting was <br />reconvened at 9:00 P.M., with <br /> <br />CITY COUNCIL -316- September 20, 1971 <br /> <br /> <br />
