PUBLIC HEARING The public hearing to consider <br />APPEAL NO. 278 - VA 71-34 Appeal No. 278, filed by <br />JOE SERNA Applicant Joe Serna from the <br /> Planning Commission denial of <br />Variance Application 71-34, to move two apart ment buildings onto a lot with <br />existing dwellings in the R -2 District at 4625-4631 West McFadden Avenue, <br />was opened by the Mayor. <br /> <br />The Director of Planning reported on the Variance application and stated that <br />the Planning Commission, acting on the recommendation of the Planning <br />Department, had denied the application because it did not comply with the <br />General Plan; would be detrimental to existing and proposed development in <br />the area; and does not conform to the R 2 density or minimum unit size. <br /> <br />The following persons spoke in favor of granting the Variance: <br /> <br />John McDonald, Attorney, (representing the applicant), 206 W. <br /> 4%h Street; <br />Josephine Serna, 4631W. McFadden; <br />Edward Bien, 4610 Hollywood Blvd., Los Angeles. <br /> <br />The proponents stated that the density requested is 27 percent over the <br />limitation; that the variance would permit 19 units to the acre, while the Code <br />allows 15 in the R 2 zone; that there are 26 units at Newhope and Euclid, <br />therefore, the request is not unprecedented; that the property owne.r should <br />be allowed to develop his property within the limits of economics; that the <br />area is not strictly single-family residential; that it is master planned for <br />medium density; that the neighbors are not opposed to %~e units being moved onto <br />the property; that identical units have been approved by the City next to the <br />"Casa Bonita"; that the units will not place a burden on the schools; and that it <br />will improve the area. <br /> <br />A petition signed by 86 neighboring residents requesting approval of the <br />Variance and a letter from Mr. Ben C. Munoz, businessman, 1328 West <br />First Street, endorsing the proposal, were received and filed on the unanimously <br />approved motion of Councilman Herrin, seconded by Councilman Villa. <br /> <br />The decision of the Planning Commission was overruled and the City Attorney <br />was instructed to prepare a Resolution granting Variance Application 71-34 <br />subject to conditions of approval contained in the Commission report except <br />that condition 6A shall be deleted and the 12 units requested to be moved onto the <br />property shall be permitted, on motion of Councilman Villa, seconded by <br />Councilman Herrin..and carried on the following roll call vote: <br /> <br />AYES: <br />NOES: <br />~BSENT: <br /> <br />Villa, Evans, Griset, Yamamoto, Patterson~ Markel, Herrin <br />None <br />None <br /> <br />CITY COUNCIL -317- September 20, 1971 <br /> <br /> <br />
