APPEAL #295 <br />VA 72-1'5 <br />CHARLES B. LINGER - (Continued) <br /> <br />Councilman Patterson stated that this particular lot is too small for the use, <br />regardless of the parking problem. <br /> <br />Councilman Patterson's motion, seconded by Councilman Markel, to uphold <br />the decision of the Planning Commission and instruct the City Attorney to prepare <br />a resolution denying Variance Application 72-15, failed on the following roll call <br />vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Patterson, Markel, Griset <br />Villa, Evans, Herrin, Yamamoto <br />None <br /> <br />The Director of Public Works stated that "full take" involves only the building; <br />that the City cannot acquire the land without the consent of the property owner; <br />that legal requirements for a commercial use are met, and if the owner wished <br />to cut off the front of the building to the new right of way line, there would be <br />no variance requirement; that the variance was filed because he wants to add onto <br />the building. <br /> <br />Councilman Yamamoto~s motion to reconsider item #72 was seconded by Council- <br />man Evans and carried on a 6-1 vote, Councilman Villa dfssentfng.~ <br /> <br />Councilman Patterson's motion, seconded by Councilman Markel, to uphold the <br />decision of the Planning Cornl~ission and instruct the City Attorney to prepare <br />a resolution denying Variance Application 72-15 carried on the following roll <br />call vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Patterson, Markel, Evans, Griset, <br />Villa, Herrin <br />None <br /> <br />Yamamoto <br /> <br />RECESS <br /> <br />present. <br /> <br />At 10:55 P.M., a recess was <br />declared. Mo with all Councilmen <br /> <br />APPEAL #296 The Mayor opened the public hearing <br />SANDPOINTE HOMEOWNERS' on Appeal #296 filed by Sandpointe <br />ASSOCIATION Homeowners' Association appealing <br /> the Planning Commission's approval <br />of Variance Application 72-10 during the 90-day moratorium set by the City Council <br />on February 22, 1972, to allow a small commercial development facing MacArthur <br />Boulevard, and 4Z townhouse units facing Main Street in the C 4 District at 3610 S. <br />Main Street. <br /> <br />The Director of Planning stated that there have been several attempts to develop <br />this property; that the property shows in the General Plan as medium density <br />residential, or eight to fifteen units per acre; that this proposal came to the staff <br />several months ago before the moratorium in the Warner-South area was set; that <br /> <br />CITY COUNCIL -123- March Z0, 1972 <br /> <br /> <br />
