VA 72-21 <br />ZACHARY T. PEDICINI - (Continued) <br /> <br />Councilman Herrin stated that the agenda material reaches Council on Thursday; <br />that if there has been a hearing on a matter by the Planning Commission and a <br />split vote is shown, or that there is a (~ifference of opinion be~een the Staff and <br />the Commission, then he will study it carefully; and that if,~each.Councilman would <br />do this, it might not be necessary to set the matter for-ano~/~e.r public hearing. <br />Councilman Patterson replied that when Variances and Conditional Use Permits <br />heard by the Planning Commission are presented to Council for affirmation of the <br />Commission decision, Council has no choice but to receive and~£ile, or to set for <br />public hearing. Councilman 1V~arkel spoke in favor of the publi~hearing. <br /> <br />Councilman Patterson's motion, seconded by Councilman Yamamoto, to set the <br />matter for public hearing on May 1, 197Z; carried on the following roll call vote: <br /> <br /> AYES: Patterson~ Yamam6to, Griset, Markel <br /> NOES: Villa, Evans, Herrin <br /> ABSENT: None <br /> <br />CUP 72-6 <br />J. OGDEN MARKEL <br /> <br />during discussion of the item. <br /> <br />Councilman Markel s~ated he is directly <br />concerned with this Conditional Use <br />Permit and left the Council Chambers <br /> <br />Councilman Herrin's motion, seconded by Councilman Patterson, to receive and <br />file CUP 72-6 failed on the following roll call vote: ~ <br /> <br /> AYES: Herrin, Patterson, Griset <br /> NOES: Villa, Evans, Yamamoto . <br /> ABSENT: Markel <br /> <br />After further discussion, Councilman Evans' motion, second~..by Councilman <br />Villa, to set for public hearing on /v~ay 1, 1972, Conditional Use Permit 7Z-6 <br />filed by J. Ogden Markel to serve beer and wine in a dance hall and dance school <br />within 300' of residentially zoned and used land; APPROVED, failed to carry on <br />the following roll call vote: <br /> <br />AYES: <br />NOES: <br />AB SENT: <br /> <br />Evans, Villa, Yamamoto <br />Herrin, Griset, Patterson <br />Markel <br /> <br />The City Attorney ruled that the Planning Commission action to approve the <br />Permit would prevail since both Council motions had re~ulte~ in a tie.
