WHO IS AN INSURED, 2. h. <br />Certain Additional Insureds By <br />Contract Or Agreement above, if <br />you specifically agree, in that <br />written contract or agreement, that <br />this insurance must be primary to, <br />and non-contributory with, such <br />"other insurance". This insurance <br />will then be applied as primary <br />insurance for damages because of <br />"bodily injury", "property damage", <br />"personal injury" or "advertising <br />injury" to which this insurance <br />applies, and we will not share those <br />damages with such "other <br />insurance". <br /> <br />(d) That is available to any insured <br />covering liability for damages <br />arising out of the premises or <br />operations for which any <br />insured has been added as an <br />additional insured; <br /> <br />(e) If the "bodily injury", "property <br />damage", "personal injury" or <br />"advertising injury", to which <br />this insurance applies, arises <br />out of the maintenance, use, <br />operation, "loading and <br />unloading" or entrustment to <br />other persons or organizations <br />of any aircraft, "auto", <br />snowmobile (or any trailer <br />designed for use, operation or <br />"loading or unloading" with any <br />snowmobile) or watercraft; or <br /> <br />(1) That is available to you <br />covering liability arising out of <br />products manufactured, sold, <br />handled or distributed by a <br />manufacturer or distributor for <br />which you have been added as <br />an additional insured because <br />you are a vendor for such <br />manufacturer's or distributor's <br />products. <br /> <br />(2) When this insurance is excess, we <br />will have no duty, under SECTION I. <br />COVERAGE, A. Liability above, to <br />defend any .suit. if any person or <br />organization providing "other <br />insurance" has a duty to defend the <br />insured against that "suit". If no <br />other person or organization <br />providing "other insurance" defends <br />the insured against that "suit", we <br />will undertake to do so, but we will <br />be entitled to the insured's rights <br />against any person or organization <br />providing "other insurance". <br /> <br />Excess Insurance <br /> <br />(1) This insurance is excess over any <br />"other insurance" whether primary, <br />excess, contingent or on any other <br />basis: <br /> <br />~ <br /> <br />(a) That is available to any insured <br />covering direct physical loss of <br />or damage to property; <br /> <br />(b) That is available to any insured <br />with respect to the conduct of <br />any past partnership, joint <br />venture, limited liability <br />company or trust; <br /> <br />(c) That is available to any insured <br />for: <br /> <br />(i) Work or operations <br />performed on that <br />insured's behalf; or <br /> <br />(ii) That insured's acts or <br />omissions in connection <br />with the general <br />supervision of such work or <br />operations; <br /> <br />(3) When this insurance is excess over <br />"other insurance", we will pay only <br />our share of the damages, if any, <br />that exceeds the sum of: <br /> <br />Includes copyrighted material of Insurance Services Office with its permission <br />Copyright Insurance Services Office, Inc., 2001 <br /> <br />Page 23 of 32 <br />
