County of San Joaquin <br />■ 6.15 RFP and Offeror's Proposal <br />This RFP and the successful respondent's proposal will become a part of the final <br />agreement. To avoid any confusion as to the set of factual assumptions a respondent uses <br />in submitting its proposal, each proposal must state specifically those factual assumptions <br />upon which each proposal is based. <br />■ 6.16 Specific Terms & Conditions <br />The successful proposer shall be expected to enter into an agreement with County. The <br />County requires that certain requirements be included in all agreements between County <br />and Proposers. These requirements are enumerated below. <br />■ 6.17 Equal Employment Opportunity <br />The Proposer shall comply with Title VI of the Civil Rights Act of 1964, as well as <br />Section 1735 of the Labor Code, which provides as follows: "No Discrimination shall be <br />made in the employment of persons upon public work because of race, religion, creed, <br />color, national origin, ancestry, physical handicap, medical condition, marital status, or <br />sex of such persons, except as provided in Section 12970 of the Government Code, and <br />every Proposer for public works violating this section is subject to all the penalties <br />imposed for a violation of (Chapter 1 of Part 7, Division 2 of the Labor Code.)" <br />6.18 Drug -Free Workplace <br />The Proposer shall provide a drug -free workplace, in accordance to the Government <br />Code for Drug Free Workplace Act, Title 1, Chapter 5.5. <br />■ 6.19 Contract Performance <br />The performance of the agreement resulting from this RFP shall be governed by and <br />interpreted under and construed according to the laws of the State of California. <br />• 6.20 Terms of Agreement & Basis for Compensation <br />Any services subject to payment must be detailed within the agreement, with desired <br />payment schedules. All payment schedules are subject to agreement between County and <br />Proposer. <br />E <br />
