County of San Joaquin ■ 6.15 RFP and Offeror's Proposal This RFP and the successful respondent's proposal will become a part of the final agreement. To avoid any confusion as to the set of factual assumptions a respondent uses in submitting its proposal, each proposal must state specifically those factual assumptions upon which each proposal is based. ■ 6.16 Specific Terms & Conditions The successful proposer shall be expected to enter into an agreement with County. The County requires that certain requirements be included in all agreements between County and Proposers. These requirements are enumerated below. ■ 6.17 Equal Employment Opportunity The Proposer shall comply with Title VI of the Civil Rights Act of 1964, as well as Section 1735 of the Labor Code, which provides as follows: "No Discrimination shall be made in the employment of persons upon public work because of race, religion, creed, color, national origin, ancestry, physical handicap, medical condition, marital status, or sex of such persons, except as provided in Section 12970 of the Government Code, and every Proposer for public works violating this section is subject to all the penalties imposed for a violation of (Chapter 1 of Part 7, Division 2 of the Labor Code.)" 6.18 Drug -Free Workplace The Proposer shall provide a drug -free workplace, in accordance to the Government Code for Drug Free Workplace Act, Title 1, Chapter 5.5. ■ 6.19 Contract Performance The performance of the agreement resulting from this RFP shall be governed by and interpreted under and construed according to the laws of the State of California. • 6.20 Terms of Agreement & Basis for Compensation Any services subject to payment must be detailed within the agreement, with desired payment schedules. All payment schedules are subject to agreement between County and Proposer. E
