<br />Variance No. 2004-08 <br />December 13, 2004 <br />Page 2 <br /> <br />The proposed changes have resulted in an increase in the size of the <br />restaurant to 4,500 square feet, which in turn has resulted in an <br />increase in the parking requirement. The parking requirement for the <br />evening and weekend uses (theater and restaurant) is now 266 spaces <br />(formerly 260). The parking requirement for the daytime uses is 42 <br />spaces for the office and ancillary storage use and 45 spaces for the <br />restaurant for a total of 87 spaces (formerly 84). Based on the revised <br />parking study, the number of parking spaces controlled by the applicant <br />exceeds the number of parking spaces required (Exhibits 4 and 5). <br />Therefore, there will no negative impacts to the community. <br /> <br />To accommodate the proposed changes, Planning Division Condition Nos. 4, <br />6, 10, 11 and 14 have been modified and one additional condition <br />(Condition No. 17) has been added. In addition, since the applicant has <br />submitted landscape plans that comply with current code requirements, <br />Condition No. 13 has been modified (Exhibits 6 and 7) . <br /> <br />Since the proposed changes do not create new impacts to the community <br />and the project continues to be compatible with the City's General Plan <br />and the standards adopted by the Midtown Specific Plan, staff recommends <br />approval of Variance No. 2004-08 as conditioned (Exhibit 8). <br /> <br />CEQA Compliance <br /> <br />In accordance with the California Environmental Quality Act, the <br />recommended action is exempt from further review.
