Conduct a public hearing to consider all protests regarding the <br />intention to levy an assessment for 2005 for the Downtown Santa <br />Ana Business Improvement Area. <br /> <br />2. Review any written protests filed prior to the close of the public <br />hearing and determine whether they constitute a majority protest. <br /> <br />3. If the Council determines that no valid majority protest was <br />lodged, adopt a resolution confirming the Annual Report for <br />Downtown Santa Ana Business Improvement Area for 2004 and levying <br />the assessment for 2005. <br /> <br />DISCUSSION <br /> <br />At its meeting of January 3, 2005, the City Council approved the Business <br />Improvement District (BID) 2004 Annual Report and the 2005 budget, as <br />revised, and Resolution 2004-093 (Resolution of Intention to Levy an <br />Assessment pursuant to California Streets and Highways Code section 36500 <br />et.al. (BID Law), as amended. Additionally, pursuant to the BID Law, the <br />City Council scheduled the public hearing to consider protests to this <br />action for its regular meeting of January 18, 2005. Individuals or <br />representatives of business that are impacted by the 2005 annual BID <br />assessment may present written and/or oral protests during this public <br />hearing. If written protests are received from business owners within the <br />Downtown Santa Ana Business Improvement Area which will pay 50 percent or <br />more of the proposed assessments and the protests are not withdrawn so as <br />to reduce number to less than 50 percent, the Council will be precluded <br />from taking any action to levy the 2005 assessment. <br /> <br />75A-1 <br />
