The City Engineer further reported that 100 percent of the <br />property owners had originally signed the petition for the <br />sanitary sewer improvement in Quigley Lane, a private street, <br />from McFadden Avenue to the southerly terminus; that the project <br />cost is approximately $20,000, which will result in an assess- <br />ment of approximately $2,000 per parcel; and that he recom- <br />mended Council proceed with the formation of the District. <br /> <br />The Clerk of the Council announced that one written communica- <br />tion had been received regarding the District on December 6, <br />1974, from Charles O. DeVoe, 733 South Newhope Street, Assessor's <br />Parcel No. 108-424-35; that he had not filed it in protest, <br />but as a statement of his inability to pay the assessment charges <br />due to an early retirement because of poor health. Each Council- <br />man had been provided with a copy of Mr. DeVoe's letter. <br /> <br />Mayor Patterson asked Mr. DeVoe if he desired to make further <br />comment and he replied that he had not intended the letter te <br />be recorded as a protest, but simply as a matter ~f information. <br /> <br />Mayor Patterson invited any other persons who wished to protest <br />or object to the work or improvement in the Assessment District <br />to de so. <br /> <br />Mr. Ray Madrid, 902 South Newhope, stated that the properties on <br />Quigley Lane are served by a dirt road which needs to be graded <br />periodically. He suggested that the road might be improved <br />under a federally funded program. <br /> <br />The City Engineer stated that the street improvement would not <br />be possible without land dedication; and that, despite efforts <br />by the City staff, it had not been possible thus far to acquire <br />all of the dedication necessary for the street improvement. <br /> <br />The City Engineer reported there were no protests to the District. <br />Whereupon, Council made a finding that there were no protests <br />to the formation of the District, on the unanimously approved <br />motion of Councilman Yamamoto, seconded by Councilman Garthe. <br /> <br />Mayor Patterson declared the public hearing closed. <br /> <br />RESOLUTION NO. 74-185 - RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA, CALIFORNIA, FINDING AND DETERMINING THAT <br />THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE CERTAIN IMPROVE- <br />MENTS IN THE CITY OF SANTA ANA, CALIFORNIA, IN ASSESSMENT DIS- <br />TRICT NO. 237 (QUIGLEY LANE); AND FURTHER THAT THE "SPECIAL <br />ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT <br />OF 1931" SHALL NOT APPLY; AND DETERMINING THAT SUCH PROJECT <br />SHALL PROCEED UNDER THE TERMS AND PROVISIONS OF THE "IMPROVE- <br />MENT ACT OF 1911" was adopted on the unanimously approved C7-0) <br />motion of Councilman Yamamoto, seconded by Councilman Markel. <br /> <br />RESOLUTION NO. 74-186 - RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA, CALIFORNIA, ORDERING THE WORK AND IMPROVE- <br />MENT TOGETHER WITH APPURTENANCES AND APPURTENANT WORK IN ASSESS- <br />MENT DISTRICT NO. 237 (QUIGLEY LANE), IN THE CITY OF SANTA ANA <br />was adopted on the unanimously approved (7-0) motion of Council- <br />man Yamamoto, seconded by Councilman Garthe. <br /> <br />RESOLUTION NO. 74-187 - A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA, CALIFORNIA, AWARDING CONTRACT FOR THE CON- <br />STRUCTION OF CERTAIN IMPROVEMENTS, TOGETHER WITH APPURTENANCES, <br />APPURTENANT WORK IN CONNECTION THEREWITH IN ASSESSMENT DISTRICT <br />NO. 237 (QUIGLEY LANE) IN THE CITY OF SANTA ANA was adopted on <br />the unanimously approved C7-0) motion of Councilman Yamamoto, <br />seconded by Councilman Garthe.
