In <br />addition, an exhibit titled Clarifications to the Draft Environmental <br />Impact Report (Exhibit B) has been provided to address comments raised at <br />the City Council meeting. <br /> <br />To facilitate the City Place development proposal, a series of actions <br />are necessary. Those actions include Environmental Impact Report, Zoning <br />Ordinance Amendment, Development Agreement, Conditional Use Permit, <br />Vesting Tentative Tract Map and Site Plan Review. <br /> <br />Environmental Impact Report <br /> <br />The California Environmental Quality Act (CEQA) requires the preparation <br />and approval of an environmental impact report (EIR) for this proj ect. <br />The environmental issues analyzed in the EIR include aesthetics, air <br />quality, cultural resources, land use, hazardous materials, <br />hydrology/water quality, noise, traffic and circulation, public services <br />and utility services. <br /> <br />The environmental impact report has identified a significant and <br />unavoidable impact to air quality and traffic. No feasible mitigation <br />measures are available to reduce these impacts. Accordingly, a Statement <br />of Overriding Considerations will be needed in order to approve the <br />project. All other potential impacts associated with the project were <br />determined to be less than significant or were provided with mitigation to <br />reduce impacts to a level considered less than significant. <br /> <br />Zoning Ordinance Amendment <br /> <br />In 1993, a specific development zone (SD-59) was approved on the site to <br />accommodate an extremely intense mixed-use project. The entitlement <br />included a 22 and 32-story office tower, 19-story residential tower (216 <br />units), hotel, parking structure, restaurants, health club, retail space, <br />cinemas and live theater, and attached residences (64 units). The total <br />proj ect gross square footage was 1,964,770 with parking to accommodate <br />5,464 spaces. <br /> <br />The specific development plan proposed for City Place incorporates the <br />intent of the previous entitled project without the high-density <br />residences or intensity of commercial space. The specific development <br />text lays out criteria for the review of the project. Due to the lower <br />scale and intensity of the proposed project, the development of the site <br />is in many ways different than that previously approved and therefore <br />requires an amendment to the current SD-59. <br /> <br />75A-3 <br />
