<br />EIR No. 2004-01; ZOA No. 2004-06; <br />DA No. 2004-04; CUP No. 2004-28; <br />VTTM No. 2004-06; and SPR No. 2004-05 <br />February 22, 2005 <br />Page 4 <br /> <br />Development Agreement <br /> <br />The development agreement establishes development intensity, density, <br />permitted uses and standards for the term of the agreement. In exchange <br />for the City vesting the standards and changing allowable intensity, the <br />development agreement requires certain public benefits. The main points <br />of the agreement include the term, residential high-rise consideration, <br />public art, Inclusionary Housing fee, Santiago Park Improvement fee, In- <br />lieu park fee, CC&R's (Conditions, Covenants and Restrictions) and <br />Cultural In-lieu fee. <br /> <br />Conditional Use Permit <br /> <br />A conditional use permit has been requested to allow the live-work <br />component of the proj ect . Should the Zoning Ordinance Amendment be <br />approved, a conditional use permit will be required for any proposed <br />live-work project within SD-59 zoning district. The live-work component <br />is envisioned to create an urban element while providing a transition <br />between the commercial uses and residential living. As the overall plan <br />is proposed, the live-work component is encouraged to link the components <br />and accentuate the District Center urban character. <br /> <br />Vesting Tentative Tract Map <br /> <br />A vesting tentative tract map is requested to allow the subdivision of <br />land and future residential condominiums. The vesting nature of the map <br />ensures that the standards to be applied to the proj ect will be those <br />adopted with the approval of the map. <br /> <br />Site Plan Review <br /> <br />Santa Ana Municipal Code requires approval of all plans <br />development area to ensure the project is in conformity <br />development standards.
