SALES ON PUBLIC PROPBRTY Council discussed the <br /> report dated May 7, <br /> : from the Assistant to <br /> the City Manager, regard- <br />ing policy with respect to sales on public property. <br /> <br />The following motion by Councilman Brandt, seconded by <br />Councilman Evans, carried (5-1) with Councilman Yamamoto <br />dissenting: <br /> <br />Delegate to the City Manager the authority to review <br />and grant permission to utilize recreational facilities <br />for the purpose of fund-raising in accordance with the <br />following standards which must be adhered to by the <br />City Manager in his action which shall be~uniform, <br />non-discriminatory and consistent in the administration <br />of granting or denying special license applications for <br />fund-raising activities conducted within parks and <br />~recreational facilities: <br /> <br />The City Manager shall consider the time, place and <br />nature of the reque~ted~fund-raising activity in <br />relation to the other proper~uses of the parks and <br />recreational facilities. <br /> <br />.The'City Manager shall consider the comfort and <br />convenience of such other proper uses of park and <br />recreational facilities. <br /> <br />The sponsoring organization shall have filed with <br />the application for special license a letter from <br />the Internal Revenue Service granting exempt status <br />to the organization. <br /> <br />4. The sponsoring organization shall have substantial <br /> membership residing within the City of Santa Ana. <br /> <br />Benefits from the sales activities shall accrue in <br />substantial part to the citizens of Santa Aha. <br /> <br />A statement shall be filed to the effect that the <br />estimated cost of the fund-raising activity shall <br />not exceed 50% of the total amount to be raised. <br />Any cost in excess of the stipulated percentages <br />shall be considered unreasonable, except that for <br />good,cause shown, the City Manager may waive the <br />stipulated percentages in a particular case. <br /> <br />The applicant and/or sponsor shall be a non-profit, <br />charitable organization. <br /> <br />The sponsoring organization or applicant shall pay <br />in advance of the event all fees and charges speci- <br />fied in the Santa Ana Municpal Code. <br /> <br />The applicant or sponsoring organization shall fur- <br />nish proof prior to the fund-raising event that the <br />City and its officers and employees are "named- <br />insured" on indemnity insurance policies in sums not <br />less than $500,000 personal injury and $100,000 <br />property damage issued by a solvent corporation <br />holding a certificate of authority to do insurance <br />business in the State of California with said <br />insurance policy containing an endorsement to'the <br />effect that no cancellation or reduction in coverage <br />of this policy for any reason whatsoever shall become <br />effective until after the date of the fund-raising <br />event. <br /> <br />CITY COUNCIL MINUTBS <br /> <br />203 MAY 12, 1975 <br /> <br /> <br />
