<br />AGREEMENT NO. C.2.0896 <br /> <br /> <br />ARTICLE 1 <br /> <br />SCOPE AND DEFINITIONS <br /> <br />1.1 Scope of Agreement <br /> <br />This Agreement specifies the procedures which the Authority and the City will follow in <br />the Preliminary Engineering (PE) and Final Environmental Impact StatemenV <br />Environmental Impact Report (FEIS/EIR) phase, including the planning, engineering, <br />and environmental processes that will be used to bring forward for decision making the <br />key issues involved in The Centerline light rail system. This Agreement also specifies <br />the manner in which the City will be reimbursed for its costs related to the activities and <br />work it performs as part of the Agreement. Both the Authority and the City agree that <br />each will cooperate and coordinate with the other in all activities covered by this <br />Agreement relating to The Centerline light rail system. . , <br /> <br />1.2 Definitions <br /> <br />For the purpose of this Agreement, the following terms shall have the meanings set <br />forth below: <br /> <br />1.2.1 Abandonment is defined as the permanent termination of a Current <br />Facility, as authorized by the Authority or the City. ' <br /> <br />1.2.2 Aliqnment (Horizontal) is defined as the centerline of a right-of-way of <br />approximately 30 feet in width required to place the tracks that allow the rail system <br />vehicles to operate in both directions. <br /> <br />1.2.3 Authoritv Representative is defined as the Chief Executive Officer of the <br />OCT A, or his/her authorized representative, who has the power to conduct meetings <br />, an'dmake approvals as required by this Agreement. <br /> <br />1.2.4 Betterment is defined as a Replacement Facility, or improvement, <br />requested by the Authority or the City that will increase the level of service and/or <br />capacity over that which is provided by the Current Facility; provided, however, that <br />measures to mitigate environmental impacts identified in the FEIS/EIR, and which are <br />hereafter mutually agreed to be a part of The Centerline light rail system, shall not be <br />considered a Betterment. <br /> <br />1.2.5 Centerline Liqht Rail System is defined as the alignment, elevation, right- <br />of-way, technology, stations, and other components that will undergo preliminary <br />engineering and environmental review in the PE and FEIS/EIR phase beginning June <br />2002. <br /> <br />2 <br />
