Smith, 15652 Williams Street, Tustin <br />Mrs. David Gross <br />Charles E. Hollingsworth, 917 West 17th Street <br />Bill Squier, 1001 West 17th Street <br />James Poor, 1060 West 17th Street <br />Douglas Minery, 917 W. 17th Street <br />Tony Wall, 1613 East Catalina <br /> <br />The opponents were generally not opposed to the refurbishing of <br />the market, but were strongly opposed to the service station, <br />stating that the additional traffic and noise generated by such <br />a business would be detrimental to the residents, as well as <br />the Baptist Church to the west of the location; that the selling <br />of diesel fuel would attract large trucks; that there are four <br />major gasoline stations within a mile of the location; that if <br />the station were not successful an abandoned gasoline station <br />is an eyesore. <br /> <br />There were no further proponents or opponents; <br />reported there were no written communications; <br />closed the public hearing. <br /> <br />the Clerk <br />and the Mayor <br /> <br />Following Council discussion, the Attorney speaking for the <br />Applicant stipulated to amend the Application to limit the <br />number of nozzles to 20 or less, to provide only one pump for <br />diesel fuel, to agree to an abandonment provision to be <br />negotiated with staff, and to limit all gasoline sales to <br />vehicles 6,000 pounds or less. <br /> <br />Appeal No. 357 was granted, and Variance Application 75-53 <br />as amended orally by Applicant at this meeting, was approved, <br />and the City Attorney was directed to prepare the appropriate <br />resolution for Council adoption, on motion of Councilman <br />Yamamoto, seconded by Councilman Brandt, and carried 5-1, <br />with Mayor Garthe dissenting. <br /> <br />Am amendment to the motion by Councilman Yamamoto, seconded by <br />Councilman Bricken, to grant the Appeal without restriction of <br />the sale of diesel fuel, failed to carry on a tie vote, with <br />Councilmen Ward and Bricken, and Mayor Garthe dissenting <br />(3-3). <br /> <br />Councilman Ward withdrew his motion to amend the main motion to <br />require negotiation with the Baptist Church to make available <br />Sunday parking in the market parking lot, and for joint use <br />of the property.
